Morning Briefs on Petitioning for Basic Constituent Services in CD 14

The late CD 14 City Councilman Art Snyder must be rolling in his Grave as constituents are force to craft Petitions for Basic Services from its current City Councilman Jose Huizar.

The Late CD 14 City Councilman Art Snyder was the Role Model for Constituent Services (and you did not need a stinking petition).

** Blogger's Note: Long ago in CD 14 Political Folklore (late 1983, early 1984), a then embattled City Councilman Art Snyder was on KABC Eyewitness Channel 7, debating Recall challengers Steve Rodriguez and Lou Moret. Snyder who was facing a strong Recall challenge (and charges of personal and political nefarious conduct), cited his much-touted reputation for responsive Constituent Services by noting a fluid "In and Out Box Flow" of resolving issues brought to his Office's attention, as a reason for remaining Councilman. Snyder won, only to resign in 1985. Now some thirty years later, the now late Art Snyder would be rolling in his grave in witnessing what has become of Constituent Services in CD 14. This week, the same KABC Channel 7 Eyewitness News reported that Highland Park Senior Citizens were relegated to crafting a Petition to CD 14 City Councilman Jose Huizar, demanding a resolution to a stalled restroom modification at the community's Senior Citizen Center, which forced the elderly to use unkempt Porta-pottys. Just recently, we were made aware of the supposed comments of CD 14 El Sereno Office Staffer Julio Torres, who stated that a Petition may garner faster attention from Councilman Huizar, regarding the Homeless/Artist Colony on the infamous Elephant Hill. Simply, this reeks of Constituent Discrimination (as documented via "Listgate" in 2011), because we know for sure that the likes of Huizar-loving Hillside Village Property Owners Association would never be force to submit a "Petition" for their desired Valley Blvd "Quiet Zone" ........, right Julio? But maybe we should submit a formal California Public Records Act Request (CPRA) to Julio, on what happen to the $5,000 given to the supposed El Sereno Chamber of Commerce? Just a thought---Scott Johnson.

Really Julio (Torres)? Your Boss (who went to Princeton), had the vision to have the taxpayers barrow $9 Million dollars to pay for a current Homeless Shelter/Encampments ......., with a hilltop view of  Huntington Drive and beyond?

** Blogger's Note: A note to our cyber audience, we will not be in the home office today, for we are on bloggin assignment to bring you the latest information on CD-14's newest Homeless Shelter/Encampments, with a hilltop view of Huntington Drive (which includes the former "Motel Huizar" location). As clearly seen from "Mickey's Parklet" located next to "Food for Less" on Huntington Drive, the Stakeholders of the El Sereno Community are commenting on their esteem, re-elected City Councilman Jose Huizar's newest answer for housing the homeless within the community. As previously reported here on Mayor Sam, the Princeton Graduate received City Council support to barrow, and pay an inflated price ($9 Million dollars to benefit the clients of  Land Use Attorney Ben Reznik) for the 20 acre, Elephant Hill Parcel in 2011. Since the transaction was completed (with the required, self-serving Photo Op completed), speculation has been rampant on what would become of the property (nature trails, interpretive signage, a Mark & Minnie Aguilar-Ferguson Nature Center among the thoughts). But come the Summer of 2015, the last option concerned Stakeholders expected, was to see tents and RVs take up positions on the hill as noted in this email, Other residents have complained to me and stated look up at elephant hill from Huntington Drive around post office. And yes there is an R.V. and a couple of tents. Thus, we load our bags (with ZIMAS Map in hand to determine property lines) to seek photographic documentation to share with you---Scott Johnson.

** For those who follow the Twitter pronouncements of CD 14 Clowncil Central Committee Communications Director Rick Coca, whoops, we meant Clowncil Central Committee Member Jose Huizar, will notice the regular supportive twitting of noted Land Use Attorney Ben Reznik (of the dubious Elephant Hill Deal). In a classic "Do as I Say, Don't Do as I Do Moment", Reznik is crying foul about a rival developer's payoff for support on a Century City Development as Bill "The Westside White Guy Emeritus" Boyarsky muses for "West LA Observed" ......

These payments, although long a dubious part of the developer-homeowner association relationship, are legal. Nobody is alleging wrongdoing. But they have become an issue in a fight over JMB Realty’s proposed 37-story Century City office building at Constellation Boulevard and Avenue of the Stars. Attorney Benjamin Reznik, who represents rival Century City property owner J.P. Morgan and the Beverlywood Homeowners Association, complained to the City Planning Commission of the conduct of four other homeowner groups who support the high rise.
He’s unhappy with JMB paying, as reported by the Los Angeles Times, $7.25 million to an organization, Friends of West L.A. for distribution to local civic institutions. Friends of West L.A. is composed of the Tract 7260 organization, California Country Club Homes Assn. Cheviot Hills Homeowners Assn. and Westwood Homeowners Assn. The associations have dropped their opposition to the project, angering homeowner groups that still oppose it.

......, meanwhile, the taxpayers are stuck with paying off the loan on a inflated-price land swindle.

City Council rubber stamps Elephant Hill parcel discount sale to Santa Monica Mountains Conservancy

 The City of Los Angeles $9 Million Dollar Elephant Hill Property. City Council just voted to sell 25% to Joe Edmiston's Santa Monica Mountains Conservancy for less than $500,000.

"Idiot" and "loser" are prominent parts of Elva Yanez's vocabulary (** especially when you oppose her). Will Elephant Hill become Yanez's and Controversial Educator Marcos Aguilar's personal play area, in thanks for their continuing support of CD 14 City Councilman Jose Huizar?

** As a disclaimer, this blogger should state for the record that I am a member of the LA-32 Neighborhood Council and at times when blog postings merge into issues that may involve the council on some level, it is best to be open and transparent about the connection. That said, there was nothing open or transparent today at City Hall regarding "the bargain basement sale" of public property to grow the land empire of SMMC/MRCA 's Joe Edmiston.

The calm before the political storm ....

Blogger Notes: We are quickly embarking on a bloggin field trip to 200 Spring Street to see what should be an eventual day of government in action. First, the "Red Rabble on the South Lawn" will likely avail themselves on their right to comment on  Mayor Antonio Villar and LAPD Chief Charlie Beck "supposed time table" to liberate the surviving green spaces around City Hall. Second, Venice Beach is on the agenda which should bring out the "noted public comment orators" of the past few years. Third, we have the Elephant Hill Boondoggle up for full council consideration. The "Valley Greuel of Audits" has "Oh My God Moment" on Investigation Oversight

 Will Los Angeles voters support a "Valley Greuel the Mayor Sequel" in 2013?

Oh My God!! Waste and corruption in city departments?

OH MY GOD! "The Valley Greuel" who daylights as the City Controller wants more investigated authority over fraud and waste in the City of Los Angeles. Totally, we get the idea that the Controller Office should have investigated powers to uncover waste and nefarious uses of Angelino tax dollars. Yet judging from the responses via the likes of the "Weekly Blond of Record" Jill Stewart and the "Daily Blogger of Fact" Ron Kaye, this latest "Valley Greuel's" pronouncement will go into the "cyberpile of name recognition exercises" that doubles for audits/press releases in the City Controller Office under her reign. But in the interest of giving the "Valley Greuel" the benefit of the doubt on her anti-waste crusade, we steer her fraud detector in the direction of a 20 acre hilltop in CD 14 known as Elephant Hill.      

Some background for the "Valley Greuel", Longtime Northeast LA activist and now blogger Tony Butka has just posted his fourth and last part on the definitive history regarding the Elephant Hill Controversy. In simplistic terms, CD 14 City Councilman Jose Huizar needed an "open space accomplishment" to help with the green vote, in his bid for a second term as councilman. Thus, using questionable legal tactics and ignoring the advise of city personal, Huizar crafted a deal that paid the owner of the property $9.1 million dollars of barrow money to preserve Elephant Hill forever as open space.

But what the "Valley Greuel" should audit/investigate is how the Santa Monica Mountains Conservancy could purchase 25% of the now city owned property for $500,000 dollars rounded off. This sweetheart deal to a client of a Councilman Huizar fundraiser (Attorney/lobbyist Ben Reznik), is a perfect proving ground to showcase how the "Valley Greuel" would use her new powers to make sure that this loan is repaid in full as promise by Councilman Huizar, with the same state dollars that SMMC is using to expand Joe Edmiston's land empire.  

But judging from the "Valley Greuel's" past support of the likes of Councilman Huizar (and blocking transparency in the CLARTS Fund) and Mayor Antonio Villar, lets not put too much substance into the latest shallow pronouncement from the Valley Greuel who dreams "totally" of becoming mayor in 2013.

Tony Butka's Part Three Post on Elephant Hill Controversy: "Enter Jose Huizar"

** Blogger Notes: As we noted earlier today, Northeast Los Angeles Blogger Tony Butka has a series of blog posts at his nelalives.com blog that chronicles the evolution of the Elephant Hill Controversy from its initial development proposals, to its $9.1 Million Dollars purchase by the City of Los Angeles. In Part Three of his series "Enter Jose Huizar", Butka highlights the questionable actions of Councilman Huizar, Ed Reyes (and Jack Weiss) via their role on the Planning and Land Use Management (PLUM) Committee, which led to this inflated purchase via barrow money. Excerpts below---Scott Johnson

Councilman Huizar's role in "exempting" Elephant Hill from Interim Control Ordinance (ICO) on Hillside Development: Moving throughout 2006, the City political machine mostly blew off all protests over the Interim Control Ordinance.  In retrospect, two interesting events occurred almost without notice; first, the appointment by Councilman Huizar of Jessica Wethington Mclean from the Mt. Washington activists group to a staff position in CD 14 clearly signaled the Councilman & Mayor’s intent to steamroller the Interim Control Ordinance through, and two, in the fine print of the Ordinance as adopted in November 2006, the Elephant Hill project was exempted.  You got it, exempted — Section 4 (Exceptions):

“The prohibition specified in Section 2 of this ordinance shall not apply to any vesting tract subdivision, the application for which was deemed complete prior to the effective date of this ordinance.”

Councilman Huizar forces Monterey Hills Investors to submit another EIR after exempting their project from ICO: On the other hand, in a master stroke of duplicity that can only happen with career politicians, on November 28th, just days before the December 10th effective date of the new ordinance, Councilman Huizar introduced a motion to stick it to Monterey Hills Investors and require a new Environmental Impact Report.

Councilman Huizar's response to city staff concerns about supplemental EIR: Wow!   Even City Hall bureaucrats who are pretty hardened to the subterranean nature of Council politics, were shocked.  In a May 27, 2007 memo to the PLUM Committee, the Planning Department essentially told Councilman Huizar that he couldn’t do what he wanted to do, and that it was a ministerial act. And in a virtually unprecedented move, the Planning Department attached a May 22, 2007 Memo to CD14’s Jessica Wethington Mclean (remember her?) listing the questions that Council Office had been sticking to the Department, together with their response saying that they were wrong.  Wow indeed.

Politics and and money playing a role in this saga: As a back story, there is another, really wonderful conspiracy theorist dream take on all  of this litigation.  The lawsuit on behalf of Monterey Hills Investors was filed by none other that big time LA City Lobbyist Benjamin Reznik!  And good guy that he is, Ben fund raised for all three members of the PLUM Committee — Ed Reyes, Jose Huizar, and Jack Weiss.

Next in Part Four: In the final Part 4 of this article, we’ll see the other shoe drop and discover how our taxpayers dollars were once again recycled by the City and the Santa Monica Mountains Conservancy, as Elephant Hills lives on.

Mayor Sam Exclusive: Santa Monica Mountains Conservancy to pay $495.000 for 25% of Elephant Hill that City of Los Angeles barrowed $9,000,000 to purchase from Councilman Huizar campaign fundraiser client

Pause with me as we flashback to the day when CD 14 City Councilman Jose Huizar became a hero to the myopic Northeast LA Green Community as the LA Times reported on November 3, 2009.

The Los Angeles City Council voted today to settle a lawsuit over a contested 24-home subdivision planned for El Sereno, agreeing to buy the property for $9 million so it can be converted into a park.

The developers of the property, Monterey Hills Investors, sued the city last year after the council demanded more environmental review of the project, planned for a site known as Elephant Hill.

Councilman Jose Huizar said the city would borrow money in the short term to pay for the purchase of the 19-acre site. Over the long term the city will seek state funding to help defray the cost, he said.

"This is an environmental justice victory because proper environmental review was not conducted" on the planned subdivision, said Huizar, whose district includes El Sereno. 

Not all were ready to give Councilman Huizar credit that day as we noted here at Mayor Sam, but some 21 months later, the true winners and losers in this deal are becoming ever clearer. More on that after the bloggin leap.

City Council votes to pay $9,000,000 for Elephant Hill Property to settle Lawsuit

"Elva Yanez and environmentalists win costly victory for El Sereno's Elephant Hill"

Environmental justice victory or suspicious dealings?

One can't blame El Sereno activist Elva Yanez for being thrill with today's City Council vote to pay $9,000,000 for the El Sereno hillside parcel known as Elephant Hill. But what started years ago as an grass-roots effort to preserve one of the last open space areas in Northeast LA, has been corrupted with political intrigue and suspicious dealings.

Some background on today's developments as reported by Los Angeles Times reporter David Zahniser.

The Los Angeles City Council voted today to settle a lawsuit over a contested 24-home subdivision planned for El Sereno, agreeing to buy the property for $9 million so it can be converted into a park.

The developers of the property, Monterey Hills Investors, sued the city last year after the council demanded more environmental review of the project, planned for a site known as Elephant Hill.

Councilman Jose Huizar said the city would borrow money in the short term to pay for the purchase of the 19-acre site. Over the long term the city will seek state funding to help defray the cost, he said.

"This is an environmental justice victory because proper environmental review was not conducted" on the planned subdivision, said Huizar, whose district includes El Sereno.

A Superior Court judge had a different view, ruling in January that the council had no authority to order Monterey Hills Investors to perform a new environmental impact report on the project.

In the wake of that ruling, attorney Ben Reznik, a City Hall lobbyist who represents the developer, vowed to seek damages of at least $8 million, saying the city's actions postponed completion of his client's project until after the collapse of the region's real estate market.

Can you see the political rats running for cover? Smell the onerous stench of political deceit?

Not too long in the past, El Sereno and CD 14 activists can remember an certain "CD 14 public official" who was heard telling the concern Elephant Hills activists that he thought that losing this lawsuit was possible, but moving forward was the "right" course of action. That when the cost of the 14 acre parcel was around $6,000,000 dollars.

But was doing the right thing the only consideration for Huizar? Consider these facts.

Reznik, who has held campaign fundraisers for Huizar and other city elected officials, had no comment on today's vote, saying the settlement had not been finalized. As he prepared for the damages phase of the case, Reznik gave notice that his client intended to depose Huizar, Councilman Ed Reyes and possibly employees in the mayor's office, according to a report obtained by The Times.

Hmmm, maybe the likes of Huizar, Reyes with the possible Mayor Villaraigosa's staffers in the mix, use the city treasury to "cry uncle" or was this part of an grand charade to improve the profit margin on devalue property, to help a political donor?

This deal reminds me of a microscopic version of the failed "Las Lomas Project". Replace Dan Palmer with Ben Reznik, Councilman Richard Alarcon with Councilman Huizar and David Hernandez with Elva Yanez. But sadly, there is no local version of Councilman Greig Smith to cry foul over this blantant misuse of public dollars. Then I seem to remember that the likes of Councilman Reyes and Huizar were supporters of the Las Lomas Project, as this passage reminds us.

"Our city attorney has said that if we fail to move forward, he believes we are in great jeopardy of being sued," said Councilman Richard Alarcon, whose San Fernando Valley district borders the Las Lomas site.

Alarcon voted to keep the project alive, along with council members Ed Reyes, Jose Huizar, Herb Wesson and Bernard C. Parks.

Strange how Alarcon, in his support of the Las Lomas Project, sounds so much like Councilman Huizar in his support of the Elephant Hill settlement.

Then there is this simple fact for CD 14 open space advocates to ponder. With the $9,000,000 dollars that Huizar is proposing to give his campaign contributors for the Elephant Hill acreage, you could have an completed Ascot Hills Passive Park and Hazard Park Wetlands Restoration, with money left over for some of the Elephant Hills property. But then I don't have to answer to contributors and Mayor Villaraigosa.
