Metropolitan has learned that because of recent take and entrainment of delta smelt at the Harvey O. Banks Pumping Plant, the state Department of Water Resources is considering temporarily shutting down the State Water Project pumps. DWR is expected to announce a decision regarding a potential pump shutdown within the next 24 hours.

We will be actively working with DWR and the other State Water Contractors on contingency plans to meet local water demands. We will keep you posted as events unfold.

AP - Sen. Hillary Rodham Clinton's political courtship of Mayor Antonio Villaraigosa landed her an early, influential endorsement this week that highlights the intense competition among presidential candidates for support within the growing Hispanic population.

Candidates in both major parties are reaching out to Hispanic voters with an intensity that speaks to the importance of the nation's largest and fastest-growing minority group in the 2008 campaign.

Immigration reform is a touchstone issue for many Hispanics, particularly in cities like Los Angeles, which has strong cultural and economic ties to Mexico. California has as many as 3 million illegal immigrants, the most of any state.

Villaraigosa's support for Clinton rested in part on their agreement on the need for a federal law that would include a pathway to citizenship for many of the estimated 12 million illegal immigrants in the country, among other provisions.

The senator earlier hired Villaraigosa political adviser (and blog spin doctor to combat anti-Villaraigosa political activist Zuma Dogg) Michael Trujillo to run her California campaign and named state Assembly Speaker Fabian Nunez, a close friend of the mayor and another prominent Hispanic politician, a national co-chair of her campaign.

I checked the lacity website today to research this file number a little more, and it was removed from the website. So I contacted the City Clerk's office and the item has been referred back to the Housing and Economic Committee. So it's not a vote on Friday, looks like they are drafting the ordinance in Committee; then hopefully, it will have to be sent back to be amended; then put before Council; then have to be continued; then sent back to committee for revision/amendments; then put before a vote of Council -- we can only hope.

Otherwise, look for a magic bullet train from San Francisco to San Diego; or LA to Las Vegas, coming to the home or business in YOUR CRA area, soon. Cause the rich real estate investors who are moving out of Los Angeles and into Las Vegas need a fast and easy way to commute back to LA for their business meetings and to visit the properties they own in LA.

But not everyone is a rich property developer who moved to Vegas (I'm told Asian's especially love leaving LA and moving to LV.) So to all the everyday, average types and flat out low income earners, who can now travel to Vegas more conventionally: Now you can hop the train to Vegas after work on Friday, lose all your money and return to LA with even more financial problems before bedtime. So sounds like it's a win-win for everybody!

AND, I heard the San Diego Association of Government (SD SCAG) feels the SF to SD bullet train doesn't go far enough, and they want it to extend right into Mexico. So you can travel back and forth from Mexico to anywhere else in California on the train. (I think that's a good idea, because no immediate concerns national safety comes to mind.)

The SF to SD magic bullet train still has to be put to a vote of the people. The Vegas train people are saying can be built in 2-3 years once they press the start button, cause they will have crews in Vegas and L.A. working simultaneously.

When concerns of Eminent Domain taking people's home for the magic train, that will get you to SF or SD much faster (if that's a priority for you) was brought up to FLY LA project presenters, we were told, "It's not the kind of train that is going to run through neighborhoods. But industry, yes. So we will have to claim eminent domain in business areas. It is not our goal to take your homes."

Great, so you won't lose your home, you'll only lose your job, or business. And of course some homes would have to go as well, too. Just not the "goal".

So I hope they hurry up and draft that Eminent Domain ordinance and vote it in...Because I do not feel this is a good time for the City and State to be focusing on basics. The City is in pretty good shape. I think the time is now to spend billions and billions and billions and billions on multiple magic bullet train projects for the rich to turn the whole region into a daily suburban commute. We can call it Los Vegas, North Mexico. (And forget SCAG, we need a new one from SF to SD, and LA to LV.) That's gonna be the new region for daily commute of rich business people and degenerate gamblers. Better use that Eminent Domain and build some casinos here in LA, so people don't abandon the City entirely. Oh yeah, you're trying. Thanks! Herb Wesson for Mayor. He never met a casino vote he didn't like. (Check the record y'all!)

The first thing I'll do is speed up the Eminent Domain process so we can start clearing out the homes and businesses so we can start building all these competing rail projects that have to fight for the rail space, and there is plenty of money to fund all of these projects at the same time. Naddering Glassell Park Neighborhood Council Naybobs Ignore Brown Act

This video almost makes me ashamed to be a Neighborhood Council member, even though I belong to a different Council. At least in our Council stakeholders are respected and given the right to speak even if they show up in a construction helmet complaining about blowing tree limbs (true story). Anyway, I digress.

Here a member of the community has freaked out an assortment of seemingly brain dead Council members when she videotapes the meeting. The ensuing debate would be funny if it were not so scary. This stakeholder has every right to video tape the meeting and the members as per the Brown Act.

I know we have fans over at the City Attorney's office who read this blog. Watch this video and let me know, what say you?

It might be time for a Glassell Park visit by the Dogg/Dowd production team who have experience instructing idiots that this is still America.

Home Depot Goes North

Even more reason to open a Home Depot in Sunland-Tujunga.

One of the "arguments" the nutcase NIMBYs who oppose Home Depots anyplace anywhere is that there are "too many" of them.

Soon there will be one less Home Depot. The Glendale store is closing to be replaced by a high-density housing development.

Just like the City Council inappropriately getting wrapped up in foreign policy issues, the Palms Neighborhood Council is considering a straw vote on the war in Iraq. However, cooler heads may be prevailing as members of the Council's Outreach and Communications Committee voted 3-0 against the idea of a vote, citing the role of the Council is to weigh in on local issues. I couldn't agree more. There's enough contention with regard to neighborhood matters; the Council doesn't need to get people riled up on an issue as hotly contested as this which the Council has zero jurisdiction over anyway.

The buzz is that "Law and Order" cast member and former US Senator Fred Thompson is running for President; one of his co-stars is playing Presidential politics of his own. Cast member Sam Waterston is amongst those behind Unity 08, an effort to recruit a moderate third party Presidential ticket consisting of one Democrat and one Republican.

Kevin James Correctly Evaluates Villaraigosa's Vice-Presidential Goals

Kevin James has inferred, as has yours truly in the past, that Villaraigosa hopes to become Hillary's vice-presidential candidate. The goal became apparent almost as soon as Villaraigosa went from his position as pretend Council Member to pretend Mayor. Why else would L.A.'s Mayor go traipsing around the world posing for photo-ops? He needed to build up a collection of nice photos for the collage during the Democratic National Convention.

Does anyone out there think Villaraigosa would survive the Vice-Presidential vetting process? Anyone think Hillary will promise him some other position and, if so, what would it take for him to pass up the chance to become governor? Ambassador to Mexico? To El Salvador?

Anyhow, if you want local politics at night, listen to Kevin on 870 AM at 9:00 a.m. Hey, everything on TV is re-runs anyway.

One slight and ironic problem: there's a Spanish-language station that crowd into the same bandwith! You may need to re-orient your AM antenna.

Home Depot Goes South, Part Deux


The NHDC made a trip downtown today to review all of the documents that have been submitted for the June 7th Hearing for Home Depot's Appeal to the City. Imagine our surprise when we came across a group of petitions, signed by about 20 people, with a logo at the top that said "Stop Racism". Imagine our greater surprise when we saw that all of the petitions were signed by people that do not live in Sunland-Tujunga.
Arleta, Pacoima, Moorpark and LA, were all represented, but not a single signature from any resident of Sunland-Tujunga!
Did these petitions even make it up here to our little foothill community? Now, imagine our even greater surprise when we saw that the handwriting on the majority of the petitions appeared to be the same scribe! The petitions also had a link to their website: http://www.stopracismca.com Go look at their website and follow their few links.
I'll wait for you.

"Racism is very much a reality in many communities today, and we need your help to fight it!
The proposed Home Depot store in Sunland-Tujunga area has brought out to light the prevalence

"DISCONCERTED" ELECTED CITY OFFICIAL ED REYES DECLARES, "How can WE REGAIN Public Confidence?" [ED, Did I miss the VOTE of that Position?]


LOS ANGELES CITY COUNCIL MEMBER (and Antonio Villaraigosa ally) -- please stop undermining the credibility and effectiveness of The City of Los Angeles, as you do when you stated in the LA Times that,

"Bratton's report spent too much time discussing "agitators" throwing bottles but not enough on who was responsible for force by officers "that crossed the line. I'm disconcerted. The issue of accountability needs to be addressed more. If we can't show accountability, how can we regain the public's confidence?" [Elected City representative CM Ed Reyes]

EXCUSE ME, COUNCILMEMBER. You are an elected representive. You are not a political activist. Ed, have you made the final conclusion, based on your report that we can't show accountability? You are an elected representative, Ed, not a political activist...so unless you took a vote of the people, do not say "RE-GAIN" public confindence, unless you have election results that show people HAVE lost confidence.

Otherwise, take off your suit, put on a ski cap and glasses, don't shave -- and give a public comment to the other 14 from ZD's side of the rope. OTHERWISE -- SHUT THE F*CK UP!!! You made these comments BEFORE the Bratton presentation today. But more importantly...you have given people the "fuel for further fire", you big dummy.

ED, you work for the City of Los Angeles. LAPD works for the City of Los Angeles. It is not good PR to bash your team mates. Don't you know in America, elected officials don't say these things to the media?

Did the LAPD say to the LA Times, "Ed Reyes is being sued in FEDERAL COURT by a former employees over civil rights violations -- AND IT'S GONNA COST THE CITY PLENTY IN OUTSIDE COUNSEL"? (You can minimize the suit, but LAPD didn't blab it to LA Times.)

Did LAPD run to the media and say, "Ed Reyes' LA River project is not even a f*cking watershed. It's just a front to funnel a bunch of money into the CRA project from all over the place -- and build skyloads of high density housing, when DWP cannot assure water to these projects. (See Daily News, Zuma Dogg and LAzy Times stories) I say the shadiness on LA River, runs deep. Y'all will be reading about it here, soon.

The Community Redevelopment Law authorizes the establishment of
redevelopment agencies in communities in order to address the effects of
blight, as defined, in those communities and requires those agencies to
prepare, or cause to be prepared, and approve a redevelopment plan for
each project area. Existing law requires that a redevelopment plan contain
certain provisions and authorizes a plan to provide for the agency to
acquire by gift, purchase, lease, or condemnation all or part of the real
property in the project area. Existing law permits an agency to extend the
time limitation for commencement of eminent domain proceedings to
acquire property within the project area only by amending the
redevelopment plan.
This bill would require redevelopment plans to contain a description of
the agency’s program to acquire real property by eminent domain,
including prohibitions, if any, on the use of eminent domain. The bill
would require a redevelopment agency to find, based on substantial
evidence, that significant blight remains in the project area and cannot be
eliminated without the use of eminent domain before amending a
redevelopment plan to extend the time limitation for the commencement of
eminent domain proceedings to acquire property within the project area.
By requiring a redevelopment agency that has adopted a final
redevelopment plan on or before January 1, 2007, to amend that plan, this
bill would impose a state-mandated local program.
The California Constitution requires the state to reimburse local
agencies and school districts for certain costs mandated by the state.
Statutory provisions establish procedures for making that reimbursement.
This bill would provide that, if the Commission on State Mandates
determines that the bill contains costs mandated by the state,
reimbursement for those costs shall be made pursuant to these statutory
provisions.

The people of the State of California do enact as follows:
SECTION 1. Section 33333.2 of the Health and Safety Code is
amended to read:
33333.2. (a) A redevelopment plan containing the provisions set forth
in Section 33670 shall contain all of the following limitations. A
redevelopment plan that does not contain the provisions set forth in
Section 33670 shall contain the limitations in paragraph (4):
(1) (A) A time limit on the establishing of loans, advances, and
indebtedness to be paid with the proceeds of property taxes received
pursuant to Section 33670 to finance in whole or in part the redevelopment
project, which may not exceed 20 years from the adoption of the
redevelopment plan, except by amendment of the redevelopment plan as
authorized by subparagraph (B). This limit, however, shall not prevent
agencies from incurring debt to be paid from the Low and Moderate
Income Housing Fund or establishing more debt in order to fulfill the
agency’s housing obligations under subdivision (a) of Section 33333.8.
The loans, advances, or indebtedness may be repaid over a period of time
longer than this time limit as provided in this section. No loans, advances,
or indebtedness to be repaid from the allocation of taxes shall be
established or incurred by the agency beyond this time limitation. This
limit shall not prevent agencies from refinancing, refunding, or
restructuring indebtedness after the time limit if the indebtedness is not
increased and the time during which the indebtedness is to be repaid is not
extended beyond the time limit to repay indebtedness required by this
section.
(B) The time limitation established by subparagraph (A) may be
extended only by amendment of the redevelopment plan after the agency
finds, based on substantial evidence, that (i) significant blight remains
within the project area; and (ii) this blight cannot be eliminated without the
establishment of additional debt. However, this amended time limitation
may not exceed 30 years from the effective date of the ordinance adopting
the redevelopment plan, except as necessary to comply with subdivision
(a) of Section 33333.8.
(2) A time limit, not to exceed 30 years from the adoption of the
redevelopment plan, on the effectiveness of the redevelopment plan. After
the time limit on the effectiveness of the redevelopment plan, the agency
shall have no authority to act pursuant to the redevelopment plan except to
pay previously incurred indebtedness and to enforce existing covenants or
contracts, unless the agency has not completed its housing obligations
pursuant to subdivision (a) of Section 33333.8, in which case the agency
shall retain its authority to implement requirements under subdivision (a)
of Section 33333.8, including its ability to incur and pay indebtedness for
this purpose, and shall use this authority to complete these housing
obligations as soon as is reasonably possible.
(3) A time limit, not to exceed 45 years from the adoption of the
redevelopment plan, to repay indebtedness with the proceeds of property

taxes received pursuant to Section 33670. After the time limit established
pursuant to this paragraph, an agency may not receive property taxes
pursuant to Section 33670, except as necessary to comply with subdivision
(a) of Section 33333.8.
(4) A time limit, not to exceed 12 years from the adoption of the
redevelopment plan, for commencement of eminent domain proceedings to
acquire property within the project area. This time limitation may be
extended only by amendment of the redevelopment plan after the agency
finds, based on substantial evidence, both of the following:
(A) That significant blight remains within the project area.
(B) That this blight cannot be eliminated without the use of eminent
domain.
(b) If a redevelopment plan is amended to add territory, the amendment
shall contain the time limits required by this section.
(c) When an agency is required to make a payment pursuant to Section
33681.9, the legislative body may amend the redevelopment plan to extend
the time limits required pursuant to paragraphs (2) and (3) of subdivision
(a) by one year by adoption of an ordinance. In adopting this ordinance,
neither the legislative body nor the agency is required to comply with
Section 33354.6, Article 12 (commencing with Section 33450), or any
other provision of this part relating to the amendment of redevelopment
plans.
(d) When an agency is required pursuant to Section 33681.12 to make a
payment to the county auditor for deposit in the county’s Educational
Revenue Augmentation Fund created pursuant to Article 3 (commencing
with Section 97) of Chapter 6 of Part 0.5 of Division 1 of the Revenue and
Taxation Code, the legislative body may amend the redevelopment plan to
extend the time limits required pursuant to paragraphs (2) and (3) of
subdivision (a) by the following:
(1) One year for each year in which a payment is made, if the time limit
for the effectiveness of the redevelopment plan established pursuant to
paragraph (2) of subdivision (a) is 10 years or less from the last day of the
fiscal year in which such a payment is made.
(2) One year for each year in which a payment is made, if both of the
following apply:
(A) The time limit for the effectiveness of the redevelopment plan
established pursuant to paragraph (2) of subdivision (a) is more than 10
years but less than 20 years from the last day of the fiscal year in which a
payment is made.
(B) The legislative body determines in the ordinance adopting the
amendment that, with respect to the project, all of the following apply:
(i) The agency is in compliance with the requirements of Section
33334.2 or 33334.6, as applicable.
(ii) The agency has adopted an implementation plan in accordance with
the requirements of Section 33490.
(iii) The agency is in compliance with subdivisions (a) and (b) of
Section 33413, to the extent applicable.

(iv) The agency is not subject to sanctions pursuant to subdivision (e)
of Section 33334.12 for failure to expend, encumber, or disburse an excess
surplus.
(3) This subdivision shall not apply to any redevelopment plan if the
time limits for the effectiveness of the redevelopment plan established
pursuant to paragraph (2) of subdivision (a) is more than 20 years after the
last day of the fiscal year in which a payment is made.
(4) The legislative body by ordinance may adopt the amendments
provided for under this subdivision following a public hearing. Notice of
the public hearing shall be mailed to the governing body of each of the
affected taxing entities at least 30 days prior to the hearing. Notice shall
also be published in a newspaper of general circulation in the community
at least once, not less than 10 days prior to the date of the public hearing.
The ordinance shall contain a finding of the legislative body that funds
used to make a payment to the county’s Educational Revenue
Augmentation Fund pursuant to Section 33681.12 would otherwise have
been used to pay the costs of projects and activities necessary to carry out
the goals and objectives of the redevelopment plan. In adopting an
ordinance pursuant to this subdivision, neither the legislative body nor the
agency is required to comply with Section 33354.6, Article 12
(commencing with Section 33450), or any other provision of this part.
(e) This section shall apply only to redevelopment projects for which a
final redevelopment plan is adopted pursuant to Article 5 (commencing
with Section 33360) on or after January 1, 1994, and to amendments that
add territory and that are adopted on or after January 1, 1994.
SEC. 2. Section 33333.4 of the Health and Safety Code is amended to
read:
33333.4. (a) Every legislative body that adopted a final redevelopment
plan prior to October 1, 1976, that contains the provisions set forth in
Section 33670 but does not contain all of the limitations required by
Section 33333.2, shall adopt an ordinance on or before December 31,
1986, that contains all of the following:
(1) A limitation on the number of dollars of taxes that may be divided
and allocated to the redevelopment agency pursuant to the plan, including
any amendments to the plan. Taxes shall not be divided and shall not be
allocated to the redevelopment agency beyond that limitation, except as
necessary to comply with subdivision (a) of Section 33333.8.
(2) A time limit on the establishing of loans, advances, and
indebtedness to finance in whole, or in part, the redevelopment project. No
loans, advances, or indebtedness to be repaid from the allocation of taxes
shall be established or incurred by the agency beyond the time limitation,
except as necessary to comply with subdivision (a) of Section 33333.8.
(3) A time limit, not to exceed 12 years, for commencement of eminent
domain proceedings to acquire property within the project area. This time
limitation may be extended only by amendment of the redevelopment plan
after the agency finds, based on substantial evidence, both of the
following:

(A) That significant blight remains within the project area.
(B) That this blight cannot be eliminated without the use of eminent
domain.
(b) The limitations established in the ordinance adopted pursuant to this
section shall apply to the redevelopment plan as if the redevelopment plan
had been amended to include those limitations. However, in adopting the
ordinance, neither the legislative body nor the agency is required to
comply with Article 12 (commencing with Section 33450) or any other
provision of this part relating to the amendment of redevelopment plans.
(c) The limitations established in the ordinance adopted pursuant to this
section shall not be applied to limit allocation of taxes to an agency to the
extent required to eliminate project deficits created under subdivision (g)
of Section 33334.6 in accordance with the plan adopted pursuant thereto
for the purpose of eliminating the deficit or to comply with subdivision (a)
of Section 33333.8. In the event of a conflict between these limitations and
the obligations under Section 33334.6 or subdivision (a) of Section
33333.8, the legislative body shall amend the ordinance adopted pursuant
to this section to modify the limitations to the extent necessary to permit
compliance with the plan adopted pursuant to subdivision (g) of Section
33334.6, to permit compliance with subdivision (a) of Section 33333.8,
and to allow full expenditure of moneys in the agency’s Low and
Moderate Income Housing Fund in accordance with Section 33334.3. The
procedure for amending the ordinance pursuant to this subdivision shall be
the same as for adopting the ordinance under subdivision (b).
(d) This section shall not be construed to allow the impairment of any
obligation or indebtedness incurred by the legislative body or the agency
pursuant to this part.
(e) In any litigation to challenge or attack any ordinance adopted
pursuant to this section, the court shall sustain the actions of the legislative
body and the agency unless the court finds those actions were arbitrary or
capricious. The Legislature finds and declares that this is necessary
because redevelopment agencies with project areas established prior to
October 1, 1976, have incurred existing obligations and indebtedness and
have adopted projects, programs, and activities with the authority to
receive and pledge the entire allocation of taxes authorized by Section
33670 and that it is necessary to protect against the possible impairment of
existing obligations and indebtedness and to allow the completion of
adopted projects and programs.
(f) The ordinance adopted by the legislative body in compliance with
this section does not relieve any agency of its obligations under Section
33333.8, 33334.2, 33334.3, Article 9 (commencing with Section 33410),
or any other requirement contained in this part.
(g) A redevelopment plan adopted on or after October 1, 1976, and
prior to January 1, 1994, containing the provisions set forth in Section
33670, shall also contain:
(1) A limitation on the number of dollars of taxes that may be divided
and allocated to the agency pursuant to the plan, including any

amendments to the plan. Taxes shall not be divided and shall not be
allocated to the agency beyond this limitation, except pursuant to
amendment of the redevelopment plan, or as necessary to comply with

read:
33342.5. (a) A redevelopment plan adopted on or after January 1,
2007, shall describe the agency’s program to acquire real property by
eminent domain.
(b) The plan may prohibit the agency from acquiring by eminent
domain specified types of real property, including, but not limited to,
owner-occupied residences, single-family residences, or any residential
property. The plan may prohibit the agency from acquiring by eminent
domain real property in specified locations within the project area.
(c) An agency’s program to acquire real property by eminent domain
may be changed only by amending the redevelopment plan pursuant to
Article 12 (commencing with Section 33450).

any residential property. The plan may prohibit the agency from acquiring
by eminent domain real property in specified locations within the project
area.
(b) An agency’s program to acquire real property by eminent domain
may be changed only by amending the redevelopment plan, pursuant to
Article 12 (commencing with Section 33450).
SEC. 5. If the Commission on State Mandates determines that this act
contains costs mandated by the state, reimbursement to local agencies and
school districts for those costs shall be made pursuant to Part 7
(commencing with Section 17500) of Division 4 of Title 2 of the
Government Code.

New High Tech Parking Meters Coming?

The City of LA's parking meters for the most part operate on 1930s technology and the Department of Transportation is looking to replace them. And of course, lobbyists for parking meter companies are chomping at the bit and are in a bit of lather about the Department's plan to follow a process to allow them to procure meters in a more streamlined and cost efficient way as opposed to the usual bid process.

One type of system under consideration is one that allows the parker to use cash or a debit or credit card to purchase a parking pass as opposed to dropping a coin in a meter. That makes a lot more sense.

Though the Clowncil members are addicted to the additional revenue the meters bring in, this old, dead Republican mayor is of the mind that most meters should be pulled out. Many cities such as Burbank have found that the meters deter commerce and collection of sales taxes. Remember, most shopping centers do not have parking meters - street side merchants should not have to compete with this.

The Democrat Newsom who illegally allowed gay marriage in Bagdad by the Bay (don't get your panties in a bunch - Mayor Sam is 100% in favor of marriage rights for homosexuals but it has to be done through the proper legal channels and not shoved down the throats of folks who still have an issue with it or you'll set the cause back 100 years as Newsom did) is just too right wing. Local leftists are holding a "progressive convention" in order to find the right liberal candidate to oppose Newsom.

So who says Antonio isn't willing to go out on a limb and fight for what he believes in the face of all opposition. Good for you Antonio. Back Jackass for City Attorney, be his campaign manager, and try and tell everyone the REAL reason everyone hates him.

By doing this, you're just giving the recall campaign more publicity. (I know, I know...we only probe if they are already aware of the re-call.) Dear Editor:

I have co-owned a home in the mid-Wilshire area for almost 15 years. During that time, I have seen a lot of changes in my neighborhood, some of them for better and many for worse.

Regardless, I have never served on a neighborhood committee or taken any political action either for or against any council member or developer or than voting in local elections.

Today, I received a phone call from a woman who claimed she was taking a survey for an independent company concerning quality of life issues affecting my neighborhood.

Although reluctantly, I agreed to take a few minutes to participate in her survey as I thought it might benefit my neighborhood.

Although her initial questions were indeed about the quality of life in our neighborhood, she began asking questions relating to the recall effort against Jack Weiss. Since I have observed Weiss sell out our area to developers over the past years, I did not mind expressing my support for the recall.

However, I soon noticed that the survey-taker kept asking the same questions about Weiss's recall but simply phrased differently. I assumed then this was a survey being taken to determine the popularity of this recall effort.

However, the surveyor suddenly started to ask if I would still support the Weiss recall effort if I knew that... and then she began making statements discrediting the purpose and intent behind the recall. Among the allegations were the claims that it was disgruntled developers behind the recall and as well as neighborhood association leaders on the take by those developers and these same neighborhood leaders were now punishing Jack Weiss for not paying them off 50 million dollars they had demanded to go away.

I immediately realized this "independent survey" was obviously being funded by people in Jack Weiss' camp and not a legitimate survey at all. More importantly, I knew her allegations were simply ridiculous.

I told this alleged survey-taker that, given her obviously loaded "questions," it was apparent to me she was not an independent survey but was offering further evidence of Weiss's political corruption by her transparent disinformation tactic. I thanked her for removing any doubt in my mind as to his dishonesty and desperation.

I asked her to please tell her employers that she has done a great service in removing any doubt in my mind to Weiss's culpability and that, thanks to her, I would not only ensure my recall vote is counted but inform everyone in my neighborhood how low Weiss will go to save his greedy, guilty ass.

The survey-taker hung up on me and yet I had not finished taking her survey.

I am guessing others will be contacted by the same "survey-taker" and hope they will be likewise inspired.

But why would Huizar have her do that? After all, the whole point is to have the system stacked in the houses favor. So Joe A, is that why you were so defensive when I called you today? You see people, someone told ZD that Jessica stepped down from the NC Govt Relations Committee when she went to work for Weezy. (That's cool, right?) So, I wanted to go out of my way to verify to see if this were true, because it would have reflected more positively on the situation, in my opinion.

But Joe wasn't interested in clarifying that, because he was very defensive of the fact that there was nothing illegal about it, so what is my problem with it? And that she recuses herself on issues there is a conflict of interest over.

Then I said, "Yeah, why do we have to go to these measures?" (You lose out on leadership when you do that. Just get someone who doesn't have a conflict of interest because they are not a paid City Council staffer.)

Cause here is another problem, this time as Eagle Rock NC Boardmember:

As Huizar's Planning Deputy, she has priviliged "inside" information, that is not released to the public. As NC Boardmember, she can use the information against the City, if against a City project. Or more likely, help be good PR for the City's position on a project, based on that inside info. And other NC memebers are going to be looking to her for her inside info, and that creates conflict of interest.

City Hall can defend it, and say it's legal all they want. Were talking the "perception" of impropriety. It's gonna:

* piss off the community
* create constant suspicion of all councilmembers
* undermine the credibility of the NC system
* disenfranchise the pueblos
* create outrage

PARTIAL RE-CAP OF ZD'S CONVERSATION WITH HUIZAR CHIEF AVILA:


ZD called Huizar's office, because I heard that McLean may have stepped down from NC, when she was hired by Huizar. And if so, that would seem a lot more ethical, and I think it would look a lot better. And I told him that was why I was calling.

He immediatley went into, "It's legal. What's your problem with it", mode.

I started to explain NC was created as a way for the public to provide input...

He cuts me off and says he knows what NC was created for but, "Why is this on your radar?"

I explained my concern as to the confilct of interest. His response was, "I know, I know, but why is this on your radar now?"

He defended the point as to how it was perfectly o.k., and she recuses herself over conflicts of interest and he couldn't figure out my concern, and kept asking me why it was on my radar.

I asked if he knew if she stepped down, and he told me that he did not know if she had stepped down, or not (as Govt Relations/Boardmember).

So I dug a little deeper, to find out on my own, because I didn't want to be making the claim, if she had stepped down from the Govt Relations Committee. She did indeed step down from that, but is still an Eagle Rock NC Boardmember, and has not stepped down. AND THEN, DURING THIS FOLLOW-UP (BECAUSE JOE AVILA WASN'T WILLING TO TELL ME WHETHER SHE STEPPED DOWN, OR NOT, SO I HAD TO SPEND MORE TIME AND CELL PHONE MINUTES (MONEY) TO FIND OUT SOMETHING THAT WOULD HAVE MADE HUIZAR LOOK MORE ETHICAL:

I FIND OUT SHE SITS ON THE NC REVIEW COMMISSION, AND YOU WERE WARNED BY CITY HALL PEOPLE SHE NEEDED TO STEP DOWN BEFORE YOU HIRED HER AS PLANNING DEPUTY. HA!

(It's this defensive, mean-spirited, combative, in-flexible nature that is why everyone in your district is doing so much research and hollerin at they Boy, Zuma Dogg.

I felt so bad that it was another CD 14 mess, so I told him, "I'm sorry this fell in YOUR lap. You know people in CD 14 sit there and research this stuff all day, but I'll be looking into this, city wide in all districts. Daily News Publishes My Platform's "Walk To Work" Initiatives

Today the Los Angeles Daily News published, with a few revisions (e.g., I would never use the word "incentivize"), an essay I wrote in early March 2007 on my platform's "walk to work" initiatives. Here's the link: "Living close to job would clear traffic."

We can attack the traffic problem by amending laws that make it hard for people to find homes near their jobs.

One reason people can't find a place to live near their jobs is rent control, which effectively makes 550,000 to 620,000 apartments unavailable to commuters at any price. The result is a distorted housing market. Owners of non-rent-controlled units charge higher prices than otherwise, because they don't have to compete with the rent controlled units.

So one of my walk-to-work initiatives is to repeal rent control -- while guaranteeing 100% Section 8 housing assistance at market rates for any qualified person who is adversely affected by the repeal.

Another walk-to-work initiative is to make Proposition 13 "portable" for anyone who is moving to a home within a mile of his or her job. That way, a person who wants to sell one home to buy another, much closer to work, will not have to pay a massive tax penalty. Likewise, we should allow a first-time buyer to keep a home's existing property tax level if the home is within a mile of the buyer's workplace. This would help reduce traffic without reducing the tax revenues the properties generate.

Finally, we should provide for "instant" mixed-use zoning for the upper floors of commerical and office buildings. Owners of those buildings should be allowed to convert the upper floors to residential for people who work within a mile of the buildings.

These walk-to-work initiatives could reduce significantly the number of people stuck in traffic every day, without our having to spend billions and wait decades to build subways.

Mayor Sam's Hotsheet for Tuesday

The first annual Mayor Sam Memorial Day Barbecue was a huge success with notables in attendance such as publicist extraordinarie Edward Headington, school board candidate/king maker Louis Pugliese (he looks much better in person than in his campaign photo), ST NoHo blogger "Video" Louis Elovitz, LAX activist Robert Acherman, retired Judge Arnold Gold, Universal City-North Hollywood Jaycees President Jack Witt and of course the fabulous Joseph Mailander of Mainbrace and Mayor Sam fame - as well as spouses, significant others, children and friends. Zuma and Walter you were both very much missed.

With respect to the above, thanks to the able bartending of Louis Pugliese's main squeeze Debi, this old dead Republican mayor is not in the condition to blog too much, so, read away dum dums.

Newly re-minted Councilman Richard Alarcon has an ambitious economic development plan for the Northeast San Fernando Valley. He dismisses his opponents' views of him as "anti-business" as "racial" and states that he is both pro-Wal-Mart and anti-war. (Don't tell Joe B.)

Westside White Guy reports that Patrick McGreevy is leaving his LA Times beat at City Hall to go to the state capitol. Good riddance. I never liked him going back to his days at the Daily News when he published whatever press release the NIMBYs gave him and he never bothered to seek out alternative views.

Home Depot Goes South


Despite my lack of posts lately, I can assure you that the battle between Sunland-Tujunga and Home Depot is alive and well. If you recall, a hearing was held back in January that resulted in Home Depot having their building permits revoked. Home Depot has filed an Appeal to that decision and the final hearing on this matter will be held before the North Valley Area Planning Commission, on June 7th, 4:30 pm, at the Marvin Braude building in Van Nuys. Since this land use issue is of utmost concern to the residents of Sunland-Tujunga, a huge turn out by the community is anticipated at the hearing. Councilmember Wendy Greuel is also expected to attend and to address the Planning Commission in opposition to the proposed Home Depot.

In preparation for this hearing, Home Depot's attorneys, Latham & Watkins, have submitted a 700 page, 4 inch thick bundle of documents offered as "evidence" that they should get their permits back. As an attorney said to me, "Hey, if it takes 700 pages to make your point then you're just milking your client." In contrast, the 9-11 Commission report was 585 pages.

Home Depot has also seen fit to send a small army of signature gatherers to our little town over the holiday weekend. They were here to seek potential supporters for the proposed Home Depot. They staked themselves out at our various grocery stores and got busy. That's fine with me, but be sure and tell people, the real reason you're there, and who is paying you.

We have received numerous reports that some of these signature gatherers were claiming to be acting on behalf of the North Valley Area Planning Commission, The L.A. Housing Authority (huh?), neglecting to mention Home Depot, by name, in their pitch to passerbys, and instead saying, "Will you sign a petition to bring more jobs to the community?".

The most disturbing, and offensive statement reported made was, " The reason people don't want HD is because they don't want any Mexicans around here." This pitch, of course, was thrown out to Latino residents. Never mind that Sunland-Tujunga is around 40% Hispanic, and the NHDC has a large number of Latino supporters, just say whatever it takes to get the signature of support.

It was astonishing to witness this, to receive the reports of the racist angle, and to actually hear someone say they were contracted by the North Valley Area Planning Commission to conduct a survey. Meanwhile, underneath her "survey" page lay a stack of cards for people to sign in support of Home Depot.

The police were actually called in on several occasions to remove the paid pro Home Depot people from the various private properties they had occupied. Upon, or usually before the arrival of the LAPD , they would leave the premises, wait until the coast was clear, and then return. This scene repeated itself innumerable times over the weekend.


One's opinion on the proposed Home Depot store means nothing. One's opinion on these kind of tactics means everything.

* Did Los Angeles Mayor Antonio Villaraigosa just spend around $2 million of privately raised money (that LA Times says may be tied to City projects needing approval) to buy this month's LAUSD school board election, only to have Tamar Galatzan pull an "Antonio" herself -- by betraying supporters who put you in office and deciding NOT to vote current LAUSD President Marlene Kanter out, and vote lead muppet Monica Garcia in?

I hope not. It would be a shame if all those City projects were approved in vain.

Water wells threatened -- DWP wants action as chemicals creep into reservoir

More than four years after being warned that a creeping chemical plume was threatening Los Angeles' water supply, the DWP has shut down at least one drinking-water well because of contamination of the San Fernando Valley aquifer.

The North Hollywood well closure means that, for the first time, Los Angeles will be unable to draw its full allotment of groundwater, forcing it to import water at a cost of $7.3 million.

But more troubling than the cost, Department of Water and Power officials say, is the possibility that the contamination will spread and ruin Los Angeles' only local water supply - the gigantic San Fernando Valley underground reservoir that can serve residents in an emergency.

So, thank goodness for perfect timing with this vindicating story: Cause last week, in response to Ed Reyes and the City of Los Angeles' LA River (aka: Condorodo River, because of the high density housing projects that they don't really mention when address the project publicly), I was asking how they are going to provide water to all these housing projects when the water supply is not a constant? And it kinda feels like you are going into "Art Bell conspiracy territory" when you speculate on environmental concerns.

How And Why The L.A. Times Is Biased On Illegal Immigration

Today's edition of the L.A. Times illustrates vividly how biased the paper is in favor of illegal aliens, and why. The bias appears in the stories, and the financial motivation for the bias appears in the classified ads. Here's a review:

1. "Immigration debate puts up a wall in the GOP."
This story, on page one, above the fold, is ostensibly about how some Republicans support the immigration legislation before Congress, and others oppose it. Conspicuous by its omission from the story, however, is any mention of how that legislation could affect our nation's finances or culture. Instead, the author implies that anyone who opposes the legislation must be racist and conservative:

-- ". . . it angers the GOP's mostly white base. . ."

-- ". . . provisions that anger many conservatives . . . ."

-- ". . . we will no longer be a national party if we try to define it as a white male, cul-de-sac, gated-community party."

-- "We lost a lot of white males. . . ."

The message is that only racist conservative white males support enforcement of the laws already on the books, the laws passed by the United States Congress.

2. "Cornerstone puts the immigration issue center stage."
This article, which appears on page one of the "Arts & Music" section, reports on a play to be presented at the Armory Northwest in Pasadena, by a man named Garces, called "Los Illegals." You can pretty much guess the slant of the play. Do you think this play, by this small theater group, would get this much coverage if their play was on a different subject, or took the opposite position? Me, neither.

3. "Family crossed the border to success."
The article appears on page one, above the fold, in the "California" section. Written by Steve Lopez, it's yet another apology for illegal immigration: "It's fair to ask questions about the cost of educating illegal immigrants and treating the sick, and about their impact on the legal labor force. But I know that if my family were starving in a country with an incompetent and corrupt government, and my children might have a better future across the border, I'd do what I had to do." Well then, that makes it all right, doesn't it? Indeed, why have immigration laws at all?

4. "The next Americans - Immigrants don't destroy our national identity, they renew it."
This essay covered all of page one of the "Opinion" section, and was written by Tomas Jimenez. He refers to "an estimated 12 million unauthorized immigrants." Unauthorized?! (Is a shoplifter an "unauthorized shopper?") Jimenez also makes the following claim about the language issue:

"The growth of non-English speaking immigrant populations, particularly those that speak Spanish, and the explosive rise in commercial services and media that cater to them have led commentators such as Pat Buchanan to pronounce the coming of a polyglot society. But nothing appears to be further from the truth."

Oh really? Then consider the next item in the paper:

5. "Hoy" Classified Ads
In the "Career Builder" portion of the classified ads, there are six huge ads -- three columns wide and maybe six to ten inches high -- for jobs at Hoy. What is “Hoy?” The L.A. Times describes it thus: “Hoy Newspaper, a Tribune and Los Angeles Times Media Group Company company, is a Spanish language daily providing the Hispanic perspective from front-page news to entertainment updates.” In other words, it’s just like the L.A. Times, but in Spanish.

Hoy needs a Subject Editor, an Assistant Subject Editor, an Internet Manager, a Marketing Assistant, a Supervisor for sales, and a Telephone Sales Representative. Every single position requires, of course, that an applicant "have excellent oral and written English and Spanish language skills." Job-seekers can apply at the L.A. Times website, and, in some cases, can directly e-mail a person with an L.A. Times e-mail account.

How much income do you suppose the Tribune company would lose if all the illegal aliens in the U.S. were deported? According to a report in October 2006, weekend circulation for Hoy in Los Angeles was 300,000. It’s also published in Chicago and, until recently, New York. Oh, but that's so crass of me, isn't it? I'm sure they don't care about money. They only care about what's best for our country.
