IT AIN'T THE THIRD OR FOURTH FLOOR, BUT I WONDER IF THE HACKMAN WHO DID IT KNOWS PEOPLE INSIDE CITY HALL...ZD SAYS FIND THE IP ADDRESS OF THE HACKMAN...AND YOU WON'T NEED TO DO A "BAT COMPUTER" SEARCH TO MAKE THE SPRING STREET CONNECTION. The Computer Fraud and Abuse Act (as amended Oct. 3, 1996)
Section 1030. Fraud and related activity in connection with computers
(a) Whoever--

(1) having knowingly accessed a computer without authorization or exceeding authorized access, and by means of such conduct having obtained information that has been determined by the United States Government pursuant to an Executive order or statute to require protection against unauthorized disclosure for reasons of national defense or foreign relations, or any restricted data, as defined in paragraph y of section 11 of the Atomic Energy Act of 1954, with reason to believe that such information so obtained could be used to the injury of the United States, or to the advantage of any foreign nation, willfully communicates, delivers, transmits, or causes to be communicated, delivered, or transmitted, or attempts to communicate, deliver, transmit or cause to be communicated, delivered, or transmitted the same to any person not entitled to receive it, or willfully retains the same and fails to deliver it to the officer or employee of the United States entitled to receive it;

(2) intentionally accesses a computer without authorization or exceeds authorized access, and thereby obtains--

(A) information contained in a financial record of a financial institution, or of a card issuer as defined in section 1602(n) of title 15, or contained in a file of a consumer reporting agency on a consumer, as such terms are defined in the Fair Credit Reporting Act (15 U.S.C. 1681 et seq.);

(B) information from any department or agency of the United States; or

(C) information from any protected computer if the conduct involved an interstate or foreign communication;


(3) intentionally, without authorization to access any nonpublic computer of a department or agency of the United States, accesses such a computer of that department or agency that is exclusively for the use of the Government of the United States or, in the case of a computer not exclusively for such use, is used by or for the Government of the United States and such conduct affects that use by or for the Government of the United States;

(4) knowingly and with intent to defraud, accesses a protected computer without authorization, or exceeds authorized access, and by means of such conduct furthers the intended fraud and obtains anything of value, unless the object of the fraud and the thing obtained consists only of the use of the computer and the value of such use is not more than $5,000 in any 1-year period;

(5)

(A) knowingly causes the transmission of a program, information, code, or command, and as a result of such conduct, intentionally causes damage without authorization, to a protected computer;

(B) intentionally accesses a protected computer without authorization, and as a result of such conduct, recklessly causes damage; or

(C) intentionally accesses a protected computer without authorization, and as a result of such conduct, causes damage;


(6) knowingly and with intent to defraud traffics (as defined in section 1029) in any password or similar information through which a computer may be accessed without authorization, if--

(A) such trafficking affects interstate or foreign commerce; or

(B) such computer is used by or for the Government of the United States;


(7) with intent to extort from any person, firm, association, educational institution, financial institution, government entity, or other legal entity, any money or other thing of value, transmits in interstate or foreign commerce any communication containing any threat to cause damage to a protected computer;


shall be punished as provided in subsection (c) of this section.

(b) Whoever attempts to commit an offense under subsection (a) of this section shall be punished as provided in subsection (c) of this section.

(c) The punishment for an offense under subsection (a) or (b) of this section is--

(1)

(A) a fine under this title or imprisonment for not more than ten years, or both, in the case of an offense under subsection (a)(1) of this section which does not occur after a conviction for another offense under this section, or an attempt to commit an offense punishable under this subparagraph; and

(B) a fine under this title or imprisonment for not more than twenty years, or both, in the case of an offense under subsection (a)(1) of this section which occurs after a conviction for another offense under this section, or an attempt to commit an offense punishable under this subparagraph; and


(2)

(A) a fine under this title or imprisonment for not more than one year, or both, in the case of an offense under subsection (a)(2), (a)(3), (a)(5)(C), or (a)(6) of this section which does not occur after a conviction for another offense under this section, or an attempt to commit an offense punishable under this subparagraph; and

(B) a fine under this title or imprisonment for not more than 5 years, or both, in the case of an offense under subsection (a)(2), if--

(i) the offense was committed for purposes of commercial advantage or private financial gain;

(ii) the offense was committed in furtherance of any criminal or tortious act in violation of the Constitution or laws of the United States or of any State; or

(iii) the value of the information obtained exceeds $5,000;


(C) a fine under this title or imprisonment for not more than ten years, or both, in the case of an offense under subsection (a)(2), (a)(3) or (a)(6) of this section which occurs after a conviction for another offense under this section, or an attempt to commit an offense punishable under this subparagraph; and

(3)

(A) a fine under this title or imprisonment for not more than five years, or both, in the case of an offense under subsection (a)(4), (a)(5)(A), (a)(5)(B), or (a)(7) of this section which does not occur after a conviction for another offense under this section, or an attempt to commit an offense punishable under this subparagraph; and

(B) a fine under this title or imprisonment for not more than ten years, or both, in the case of an offense under subsection (a)(4), (a)(5)(A), (a)(5)(B), (a)(5)(C), or (a)(7)of this section which occurs after a conviction for another offense under this section, or an attempt to commit an offense punishable under this subparagraph; and


[former paragraph (4) stricken effective Oct. 11, 1996].

(d) The United States Secret Service shall, in addition to any other agency having such authority, have the authority to investigate offenses under subsections (a)(2)(A), (a)(2)(B), (a)(3), (a)(4), (a)(5), and (a)(6) of this section. Such authority of the United States Secret Service shall be exercised in accordance with an agreement which shall be entered into by the Secretary of the Treasury and the Attorney General.

(e) As used in this section--

(1) the term "computer" means an electronic, magnetic, optical, electrochemical, or other high speed data processing device performing logical, arithmetic, or storage functions, and includes any data storage facility or communications facility directly related to or operating in conjunction with such device, but such term does not include an automated typewriter or typesetter, a portable hand held calculator, or other similar device;

(2) the term "protected computer" means a computer--

(A) exclusively for the use of a financial institution or the United States Government, or, in the case of a computer not exclusively for such use, used by or for a financial institution or the United States Government and the conduct constituting the offense affects that use by or for the financial institution or the Government; or

(B) which is used in interstate or foreign commerce or communication;


(3) the term "State" includes the District of Columbia, the Commonwealth of Puerto Rico, and any other commonwealth, possession or territory of the United States;

(4) the term "financial institution" means--

(A) an institution with deposits insured by the Federal Deposit Insurance Corporation;

(B) the Federal Reserve or a member of the Federal Reserve including any Federal Reserve Bank;

(C) a credit union with accounts insured by the National Credit Union Administration;

(D) a member of the Federal home loan bank system and any home loan bank;

(E) any institution of the Farm Credit System under the Farm Credit Act of 1971;

(F) a broker-dealer registered with the Securities and Exchange Commission pursuant to section 15 of the Securities Exchange Act of 1934;

(G) the Securities Investor Protection Corporation;

(H) a branch or agency of a foreign bank (as such terms are defined in paragraphs (1) and (3) of section 1(b) of the International Banking Act of 1978); and

(I) an organization operating under section 25 or section 25(a) of the Federal Reserve Act. (5) the term "financial record" means information derived from any record held by a financial institution pertaining to a customer's relationship with the financial institution;


(6) the term "exceeds authorized access" means to access a computer with authorization and to use such access to obtain or alter information in the computer that the accesser is not entitled so to obtain or alter;

(7) the term "department of the United States" means the legislative or judicial branch of the Government or one of the executive departments enumerated in section 101 of title 5; and

(8) the term "damage" means any impairment to the integrity or availability of data, a program, a system, or information, that--

(A) causes loss aggregating at least $5,000 in value during any 1-year period to one or more individuals;

(B) modifies or impairs, or potentially modifies or impairs, the medical examination, diagnosis, treatment, or care of one or more individuals;

(C) causes physical injury to any person; or

(D) threatens public health or safety; and


(9) the term "government entity" includes the Government of the United States, any State or political subdivision of the United States, any foreign country, and any state, province, municipality, or other political subdivision of a foreign country.

(f) This section does not prohibit any lawfully authorized investigative, protective, or intelligence activity of a law enforcement agency of the United States, a State, or a political subdivision of a State, or of an intelligence agency of the United States.

(g) Any person who suffers damage or loss by reason of a violation of the section, may maintain a civil action against the violator to obtain compensatory damages and injunctive relief or other equitable relief. Damages for violations involving damage as defined in subsection (e)(8)(A) are limited to economic damages. No action may be brought under this subsection unless such action is begun within 2 years of the date of the act complained of or the date of the discovery of the damage.

(h) The Attorney General and the Secretary of the Treasury shall report to the Congress annually, during the first 3 years following the date of the enactment of this subsection, concerning investigations and prosecutions under section 1030(a)(5) of title 18, United States Code.

In today's LAT, Rick Wartzman writes about the Sprint/customer dispute in a way that looks at it differently in general business terms, not supporting Spring per se, quoting the Gospel of Peter F. Drucker (who you claim to be an expert on, laughable to a real MBA like myself).

Although Drucker's emphasis was to create and please customers, "Drucker taught something else as well: It's crucial...to decide who its customers are not...he explained: Make sure you know the bounds you are assuming and that they are the bounds you want...You can't please everybody -- and you really don't want to...These so- called demon customers...simply became too expensive to retain."

Constituents can be likened to customers insofar as they elect and pay for CM's through taxes (although the ones using up their time make little money and pay the least in taxes), and have a right to receive reasonable "service" in return, but there are firm limits.

This is not simply a financial issue (although we are paying our CM's to sit through a lot of drivel from the same "demon customers," or constituents). "This issue transcends dollars and cents. Coping with the never-satisfied diverts attention from a key management objective: providing high-quality service to the 99.9%" who make up the vast majority.

"You can't have these people (the never-satisfied demons) impinge on the service level of everybody else."

Zuma, you can't deny the validity and logic of this as the basis for why the CC wanted to keep you away.

Their attorney -- if they had one, someone who is still willing to serve under Rocky -- obviously did a very poor job making their case, and the judge is either a fool or a socialist. So don't take it as any more than a statement of logic, if people advise you to sell t-shirts

So... if taxpayers are unhappy with their service the city should break their contract with the said taxpayer and the taxpayer will not have to 'pay' the taxes???

In my experiance, the limits are often exceeded not by the taxpayer but by the local or state government. Our public schools are a very practical example, and then there are sidewalks, and public safety and...

The truth is that they worry about getting re-elected, 24-7 from the time they win their election, and if term limits is the next stop, the chore is finding a new lily pad on the pond to jump to. That is "Job Number One."

WE really don't pick them for anything as cited above- we just try to select the lesser of two or more evils presented to us. We really don't select much in the way of candidates at all.

One example- Consider Gloria Molina- she says no one runs against her because she is just doing such a good job. Hmmm. A big chunk of money available from her war chest to fend off challengers helps, too. She has 1 million dollars a year of public funds funnelled towards a Mexican American Museum- her "discretionary funds"- I think $7 Million total went for this. This should have been privately funded and the money put to something more urgently needed.

Is that her decision or her constituents' decision? No, too much power breeds arrogance and contempt more than it gets you some hard working representatives.

I am Latino but Molina did not do anything at my behest. The machine just rolls on, and over us.


BTW, did Jan Perry ever do anything about her staffer filing a false police report (stolen car) to cover his daughter wrecking the city-issued car? (See Steve Lopez' recent column). It's everywhere, all the un-accountability.

If these guys weren't so piggish, they would turn in mileage and expense reports for reimbursement instead of getting city cars as complete freebies. Then you would see some waste trimmed.

They are elected to office not because of any greatness in their quality but because of inside power dealing in candidates selected to run and even deals among the Dem and Rep for essentially "non-competing" agreements in several districts.

And, lastly, how much council meeting time is spent patting themselves on the back and on parcelling out the calligraphy-laden awards? Is that some fat that can be trimmed? How about when they decide to adjourn meetings early? They are part of the problem regarding use of available time.

But don'tcha just luvem, the whole bunch, anyway?

The City Council prides itself on being the most open legislative body anywhere, and I daresy it is; but if the privilege is abused, I'm afraid they will have to impose new rules that adversely affect everyone. There is only so much time and mental energy in their day.

PICK ANY DAY OVER THE PAST FEW MONTHS AND TRANSCRIBE ZD'S TOTAL PUBLIC COMMENTS FOR THE DAY. (5-6 minutes).

THEN...Take the same day and transcribe fice-six minutes of the CMs (you can compile from any or all of all 15)...then post both ZD/council side by side without names. Then do a research study, and see who people think is wasting the time, you inferior-strategy douche.

IT OBVIOUS AS HELL YOU HAVE NEVER READ "ART OF WAR" OR "MARKETING WARFARE"...that's why you continue to bolster my popularity.

One more quiz frustrated loser: What's worse:

a) Funneling LAUSD school construction money to you cronies through contracts and a system designed by Vegas casino consultants and all the Belmont style stuff...then asking for MORE bond money.

b) spending two minutes to talk about it.

I KNOW, I KNOW...you'd rather let billions of dollars fly out the back door, to save two minutes when the rest of council will spend up to THREE HOURS, YES...UP TO THREE HOURS (if not two) on the Friday dog and pony shows...and you'll make us sit through an hour or more discussion on an item, where all the CMs stand up and grandstand...or ask hard hitting questions, and raise all their concerns, only to vote a unanymous "yes" anyway. Empowerment Report - Council in Retreat

I wish you had been there to see it: the City Council’s two-day retreat in San Pedro. The goal was to give the members an opportunity to get to know each other better, understand each other’s priorities and concerns, and perhaps identify a handful of common issues that they, as a whole, could focus on.

It was the Council as no one has ever seen it. Talking on cell phones was only permitted during the breaks. Councilman Greig Smith was the first one to violate the “first names only” rule as he attempted to create a “no necktie” rule.

City Council President Eric Garcetti deserves a gold star. He’s too modest to take credit for this historic event, but it clearly had his fingerprints all over it.

The first achievement was getting 14 members to attend. Almost all were on time. Wendy Greuel had to attend to her mother’s funeral preparations.

Doug Epperhart, president of the Coastal San Pedro Neighborhood Council, welcomed the council members to his ‘hood.” His suggestion that neighborhood councils be involved more in the City Councils discussions found several sympathetic ears.

Each member briefly listed his or her most outstanding accomplishment, and their top district priorities. (CityWatch will make available a more detailed report shortly.)

The casual atmosphere allowed the council members to speak somewhat more freely and often more bluntly. The city did not video or audio tape the retreat, but there were reporters and others in the audience taking notes. That didn’t go unnoticed by the council members, some of whom mumbled about “that Brown Act.”

Bernie Parks reported that his district just got something they’ve been working toward for many years: market-rate housing … 200 units worth. This was met with surprise and shock by the council members who have spent time fighting for or against affordable housing in their areas.

A blunt Jack Weiss suggested that the City Council should stop being so quick to unanimously approve mayoral appointments to city commissions. He began to question the value of the commission system because of its lack of adequate accountability.

Many of the council members felt that they needed a stronger role in the city budget process. One of them commented that neighborhood councils are more involved in the development of the budget than they are.

There seemed to be agreement that they, as a City Council, wanted to go beyond being reactive and addressing issues piecemeal.

The attempt to identify three top priorities that could form, perhaps, the beginning of a strategic plan, ended with a top tier of public safety (including gangs), transportation, and housing/homeless, in that order. But there was no development of a plan for a unified effort to deal with these issues. No one really expected that there would be. After all, we’re dealing with 15 political animals who aren’t going to compromise that which will propel them to their next public office, or give them personal satisfaction.

As one neighborhood council member noted, “Hey, they’re just like us!”

However, Garcetti said that he would press ahead with plans to reserve entire City Council agendas for a single subject, streamline the celebratory … or presentation … part of meetings,, help council members organize bus tours of their districts for the other members, set up meetings with general managers to discuss projects and performance, and propose a new city budget process.

Not all council members were of the belief that neighborhood councils should be at the table when changes to the system are redesigned and new projects are discussed. Neighborhood councils should not wait to be invited in. That’s putting too much faith in the hope that the meek shall inherit the earth.

I WOULD BE STOKED TO SEE COUNCIL TAKE A FULL THREE MEETINGS IN A ROW AND ADDRESS THE PUBLIC, DIRECTLY ON KEY ISSUES:

District updates, if you will. ZD will blaze it up and try and type up some ideas. But I think what Eric is talking about falls under that umbrella, if I understand the concept correctly. (That of occasional single items for the full days discussion.) Or maybe two.

Excellent fact-gathering and delivery.

I would have included some of the details about pace and tone of the meeting.

Bernard Parks was about 1.5 hours late. He later joked that "just getting up at this age" was an accomplishment.

Also, while some of the accomplishments detailed by CMs were noteworthy, others lacked substance and context.

Janice Hahn gave an interesting account of helping a small group of watts homeowners to acquire the title deeds after decades of city inaction on their behalf. Her work culminated in real equity for local families. One woman sold her home for $350,000+.

Herb Wesson Jr. proudly beamed about his efforts to have the largest VA facility of its type funded and built in his district. He spoke of visiting a constituent whom inspired his actions who had unfortunately passed away, never to see this come to fruition.

Eric Garcetti incresed the number of parks in his district from 20-32 (approx). He has a goal which sounds attainable of having park space within walking district of every home in his district.

Jan Perry, Ed Reyes and Dennis Zine spoke esoterically about how some accomplishments go unnoticed or are hard to document.

Huizar offered some interesting points.

Janice Hahn quipped about having the only testicles at the table. Really.

Please forgive me because I have hit a memory wall. I did not crunch my notes after the meeting because I was soooo underwhelmed as to feel robbed of my time.

One interesting note was the offstage appearance by James Preston Allen, Publisher of Random Lengths, a harbor community newspaper. Allen arrived late enough to miss the morning doldrums, but too late to get his name on the public speaker list...without some hell-raising.

A city police officer could be overheard "reasoning" with the journalist. Allen stood his ground and did so without lowering his resonant voice. This made for wonderful theatrics and happened minutes before the noon break.
