Villaraigosa & City Council Vote To "Strengthen" Special Order 40; But Also Vote To Crack Down On Gangs With Tougher Sentencing

INTERGOVERNMENT RELATIONS COMMITTEE REPORT SAID (at today's council meeting/agenda item 16)...City and District Attorneys to engage in damage actions against gangs currently under injunction to recover monetary damages and to return that money to the community.

Also, cracks down on adults who recruit youth into gangs. Under the "Encouragement Action", we could charge them with "contributing to delinquency of a minor".

Will allow landlords to evict individuals for "nuisances", where owners cannot currently evict tenants.

And includes "hate crimes" as a predicate offense. (County Human Relations Committee says gang hate crime is up, according to the expert who was testifying before council.)

"Wrong Doing" Section: Will allow "us" to combine "domestic violence" charges when used against a witness testifying against gang activity.

Councilmember Janice Hahn said, "We support this package of bills and are creating new revenue streams to go to 'prevention', 'intervention', and 'youth programs', keeping kids from joining gangs in the first place." She added, "This does everything from allowing us to sue gangs for damages. The money can go back to the communities most damaged. Increase penalties at school zones. (Like construction zones that have increased fines. Now, gang free zones.)"

CM "You Go Girl" further explained that AB 1033 makes it a misdemeanor to recruit a kid into a gang." And grandstanded the editorial, "I'm surprised this hasn't been done before." [I guess we just haven't been blessed with the right fifteen, until now.]

The Show-stealing CM continues, "Third, fourth, fifth grade kids are beig recruited. Sixth grade kids (at one mentioned school) are given a choice of which gang to join. (Like a fraternity or sorority. It's a matter that the kids need to join the gang for "protection" and "safe passage". So now, it will be a misdemeanor. Without this, we won't see the end of gang violence in our lifetime." [JANICE: Congrats! You worded that in a way that doesn't offend ZD. You said, "without this we won't", instead of, "with this, we will." (And there is a HUGE difference.) Thanks for that consideration, too!]

Councilmember Tony Cardenas, not as pleased, over feelings that this "addresses half the apple, and now we would liek to address the other half." He says, "This focuses on what happens after they committ a crime. When we put them in prison, we spend upwards of $40,0000 per adult and $90,000 for juvenile incarceration. Prevention programs can cost $1200-$1300. So if we can provide legislation on the "prevention" side, I think that is a package we need for the City of Los Angeles."

CM Cardenas added a reference to legislation that (former CM) Senator Alex Padilla has worked on...which can help us curtail crime on the front and back end."

So although Cardenas supports this, he would like to have seen it go much further and address the other side of the issue (prevention) more.

Recommendation for Council action, pursuant to Resolution (Zine - Hahn), SUBJECT TO THE CONCURRENCE OF THE MAYOR: RESOLVE to include in the City’s 2007-08 State Legislative Program SUPPORT of SB 271 (Cedillo), AB 1013 (Krekorian), SB 989 (Ridley-Thomas), SB 844 (Calderon), and AB 1033 (Caballero) to allow City and County prosecutors to employ tougher sentencing measures and increase the ability of City and County prosecutors to recover damages from gang members who commit certain crimes.

Fiscal Impact Statement: None submitted by the Chief Legislative Analyst. The City Administrative Officer has not completed a financial analysis of this report.
