Los Angeles City's NEW Eminent Domain Policy Looks Like They Can Pretty Much Do Whatever The Hell They Want. [It looks like comedy!]
LOS ANGELES CITY COUNCIL VOTES 12:0 ON "EMINENT DOMAIN" PROGRAM
A new State Eminent Domain law went into effect this year, requiring the City to lay out it's ED plans for the future, before you can start claiming. Here's the plan from today's agenda, item 12. A lot of the City ED has expired and the CRA will have to pass some amendment in each of these areas. But here's one area with the most extensive ED plan: [Read my comments in bracks and comment.]
THE PROGRAM TO ACQUIRE REAL PROPERTY BY EMINENT DOMAIN OF THE COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF LOS ANGELES, CALIFORNIA
ADELANTE EASTSIDE REDEVELOPMENT PROJECT
Without the consent of an owner, the Agency shall not acquire any real property on which an existing building is to be continued on its present site and in its present form and use unless such building requires structural alteration, improvement, modernization or rehabilitation, or the site or lot on which the building is situated requires modification in size, shape or use, or it is necessary to impose upon such property any of the standards, restrictions and controls of the Redevelopment Plan and the owner fails or refuses to agree to participate in the Redevelopment Plan by executing a participation agreement.
[Basically looks to ZD, like they are saying, all they have to do is start walking around the neighborhood and start saying, "You need some structural alteration...you need some improvement modernization...you need some rehabilitation...you require some site modification...you can't use it for that anymore...and if you "refuse" (how about can't afford) to agree "participate" by executing an agreement. [Sounds like that means, "or if you don't agree to go along, we can take it, anyway."]
I DON'T KNOW...MAYBE I'M READING TOO MUCH INTO THINGS, BUT DOES THIS LOOK LIKE THE CITY'S "EMINENT DOMAIN" PLAN FOR EAST ADELANTE LOOKS LIKE IT SAYS, "We can trip you up, just about any way we feel like it, and if not, we can just take it anyway."

the CRA has to answer to the School Board, which seizes people's homes even when other sites are available, and for widening the 405 cuz we don't have the funds for the Subway to the Sea, light rail etc. that are needed, and L A just missed out on fed funds. Hey, ARnold, why didn't you pull some strings w/ your buddies in D C., you are the only Republican out WEst, you should use your clout re: funding for transportation. All the E Coast cities have good public transport, even if NYC's subways are old and hellish, but they think they should stay superior to us, that we're all lefties and marching illegals (not too far off the mark, when you look at some on CC, but they don't really rep the will of the average person who works hard to get an education and a good job, buy a house and does it all legally and don't agree that illegals should be making angry demands.)
If the School Board weren't more interested in power than the people as they claim, if the local politicos were savvier at dealing w/ D. C., the CRA wouldn't be left such a dirty job to do.
