California Supreme Court Overturns Gay Marriage Ban

The California Supreme Court ruled today in favor of overturning a ban on same-sex marriages. The Court found California laws limiting marriage to opposite-sex couples violate the constitutional rights of same-sex couples.

The ruling was authored by Chief Justice Ronald George. A snippet from the 121-page majority opinion:

"In contrast to earlier times," the opinion reads, "our state now recognizes that an individual's capacity to establish a loving and long-term committed relationship with another person and responsibly to care for and raise children does not depend upon the individual's sexual orientation." More generally, "an individual's sexual orientation -- like a person's race or gender -- does not constitute a legitimate basis upon which to deny or withhold legal rights," it says.

"In view of the substance and significance of the fundamental right to form a family relationship," the court concluded, "the California Constitution properly must be interpreted to guarantee this basic civil right to all Californians, whether gay or heterosexual, and to same-sex couples as well as to opposite-sex couples."

News flash for same-sex couples: L.A. Mayor Antonio Villaraigosa is ready to help you tie the knot, Jean-Paul Renaud reports.

"It's been a long journey to reach this historic day," [Villaraigosa] said in the courtyard of L.A.'s Gay and Lesbian Community Center. "This is about people and the right for people to love who they want."

Villaraigosa pledged his full support in campaigning against an attempt to amend the state constitution.

"I will stand with you," he said. "I will do everything in my power to keep this decision the law of the land."

what about the decision to uphold federal law and recind Special Order 40?

or do you pick and choose which laws to enforce?

Back in 2001, I was at a function held by a GLBT group and the Mayor (before he was the Mayor) was there and he was VERY supportive of their causes and issues.

I can guarantee that he is not pandering for votes because he is running. There were several of us straight people there, but we were outnumbered by the gays and I was so happy to know that there are so many politically active gays and lesbians in our City.

Congratulations to all of you gay readers and I wish you all the best! Finally we are going to treat everyone equally and this is a very good thing for California.

You are so right. It does say Adam and Eve. Genesis doesn't mention marriage.

BTW....Adam and Eve were given the freedom to chose. The only choice then was with regard to fruit on a tree. There was no mention of gay couples.

Regarding the fruit, God decided what actions to take....not the government.
