Ruby De Vera vs Ed Reyes and The City of Los Angeles Moved to FEDERAL COURT

Thanks to the ZAP (Zuma's Action Plan) Public Records Request Expert who sent me a bunch of case summaries to look through, on another matter, when this one came up in a Google search of some names. And for good reason: Mayor Sam and Joeseph Mailander blogged all about this when it happened: Here's the aftermath. Sounds more expensive than dog food.

TRANFER OF CASE TO THE HONORABLE GEORGE H. WU, United States District Judge, United States Courthouse.
The following hearing date is hearby set:

Status Conference set for May, 2 2007 at 9:00a.m.

Pretrial Conference: July 2, 2007 at 8:30am

I think the reason this story has relevance is it DID make it's way up to Federal Court, and Council has had closed door budget discussions on the matter, so it could head to a settlement. And it ain't gonna be cheap. Millions, perhaps? At first I assumed this was common knowlege, but I discovered it has yet to be reported. And hopefully, it will cause elected officials in the City to be aware of civil issues and potential "perceptual community impacts" that allow things to end up in Federal Court, and may cost millions.

Anyone can file a suit in Federal Court or State Court.

The imporant word is NON-DISCRIMINATORY

"If an employee is not under contract, he or she is an at-will employee. An employer can dismiss an at-will employee hired for an indefinite term at any time for any non-discriminatory reason. Likewise, the at-will employee is free to terminate their employment at any time. The at-will employment doctrine, however, is being eroded in many states. Some challenges and exceptions to at-will employment include: breach of implied contracts through employee handbooks, public policy violations, reliance on an offer of employment, and intentional infliction of emotional distress"

The City will pay and pay dearly...

Excuse me but "at will" or not an employee has rights of protection such as retaliation, sexual harrassements etc. under the law. Ruby will come out smelling like a rose because it was the timing that says it all in this lawsuit. IT takes guts to go after a CM in this city.

there is no sexual harrassment component to the case. when i say worked it's way up it was removed from Superior court and "kicked up" to Federal Court. Excuse me if you felt my description was inacurrate.

If you want to try to understand what happens in lawsuits, you ought to try to go to law school.

But no, that's too much like actually working, instead of dabbling in shit you know nothing about and searching for answers from folks that do understnd it.

The problem is, it is the blind leading the blind, here.

The result is a lot of misinformation and innuendo that leads to nothing.

If you weren't on Mayor Sam, no one would go to your stupid irrelevant blog.
