The Angst of Anonymity

Kentucky Representative, Tim Couch, introduced a bill last week that would effectively outlaw anonymous posting on any website. While few are quick to say "As goes Kentucky, so goes the nation," and some believe the proposed law violates the 1st Amendment, the "United We Stand, Divided We Fall" lawmaker believes that outlawing anonymous posting would curb online bullying.

Couch's bill requires that your full name, home address and email address be registered with the website. Your full name would then be published along with the post. Stephenie Steitzer of The Courier-Journal (of Louisville, Kentucky) reports: "Under House Bill 775, Web site operators would be responsible for enforcing the policy and could be fined $500 for the first offense and $1,000 for each subsequent offense."

Ed Oswald of Beta News says: "Couch seems to be directing his ire at sites like the increasingly popular JuicyCampus.com, which encourages students to post anonymous, and most times slanderous, comments about others. He says that the bullying problem is significant in his own district in eastern Kentucky. However, at the same time he says the bill could be difficult to enforce if signed into law."

Schools can and do ban their students from positing on sites that bully, but banning all anon. isn't the way to go. However, just the realization that if someone posts a lot of libel and slander, the recipient can go after them in certain circumstances, should curb some of the worst of the postings.

Individual sites can discourage or even remove anything which crosses the line into nastiness about a specific person. When zuma was here, there was so much nastiness and intentional insult directed at pols and even their assistants an families for a long time -- maybe public figures are generally exempt, but saying someone's an idiot because of policies is one thing, when people started going after the Mayor's kids was another. (That vitriol turned out to be all about a hoax, anyway.)

One guy criticized on this blog from ELA even turned up at City Hall to say he'd kick butt over his wife's honor being dragged through the mud here. That was too much too, he's just some average Joe.

No more split-personality Don Cholo though, how do we do that? I know, just censor them all on this blog.

People who just don't agree with you, are jealous, nasty losers, petty, just plain mean will attack you, anonymously. They will threaten to kill you, your family. They'll send junk mail to your house, spam you to death, leave nasty calls, put your name on sexchat websites, file false reports against you to the government and that's just for starters.

We need to be able to post anonymously so we can't be targeted. That's why I'm anonymous. I'm not anonymous because I want to libel someone or threaten to kill someone. I just don't want to be libeled or threatened. Anonymous speech is protected speech. The courts have already ruled on this issue.
