Farm Trial Evidentiary Ruling

As predicted by the Mayor Sam Legal Team, the Mayor and City Council will NOT be testifying at the urban farm trial. So reports the San Jose Mercury News.

The writers of the article in counterpunch got a lot right, but not everything.

Ralph Horowitz is a pig. On that issue, no one disagrees, even his partners, friends, family and probably his wife and children.

However, it unfairly impugns Antonio, who negotiated a purchase between Ralph and the Trust for Public Land at Ralph's asking price, only to have Ralph move the ball and demand another couple of million dollars.

At that point, the TPL and Antonio just threw up their hands and concluded that you cannot make a deal with a skunk.

We all hope the farmers win the suit; no one believes that they will. There are no squatters' rights; they did not pay taxes on the land, thus they cannot acquire it by adverse possession. A prescriptive easement is not possible as they were there with permission.

Their lawyers are feeding them lies with false hopes.

Life sucks sometimes; this is one of those times.

They had no ownership ties to the property, yet they prospered from its use. Why didn't they at the very least set aside the money collected to purchase the farm or another plot of land for a future farm? They are theives!

Huizar gets ahead of himself on school reform

THE latest in an ever-growing list of politicians to take a shot at the Los Angeles school board is none other than City Councilman Jose Huizar, who knows whereof he speaks, having previously served as the board's president.
Throwing his idea into the mix, Huizar offers a plan that's one part good, one part bad, and, all in all, premature.

What's good is a proposal to impose term limits on board members. Currently, unless they offend special interests or leave voluntarily, board members enjoy what amounts to an office for life, regardless of their performance.

It's a welcome reform, but probably not worth the price Huizar attaches to it: A massive pay raise for board members who now are given $24,000 a year. Huizar says he wants to make the members' salaries "competitive," presumably with City Council members who make six times that sum and state legislators who are not far behind - America's highest paid officials in their respective fields.

This idea is a nonstarter.

While no one can agree what to do with the school board, most everyone agrees it's done a lousy job to date. Failure doesn't deserve a pay raise.

Anyway, whatever the merits of Huizar's plan, this discussion seems rather untimely.

Given the ongoing wrangling in Sacramento over Mayor Antonio Villaraigosa's education-reform plan, it's not clear what role the board will play in the near future. And what kind of limits board members should have on their terms - let alone whether they deserve pay hikes - obviously depends on what their responsibilities are.

The best course of action for Huizar's plan at this point would be to shelve it, if not scrap it altogether.

The girl was hit in the abdomen and in a leg and was hospitalized in stable condition.

"The motive of the crime appears to be gang-related," Lopez said. He did not know whether the child was the intended target.
