Even More CD 14 Red MEAT

Seems as if the Jimenez camp is miffed at not being invited to a Neighborhood Council debate. I would think it would be good form to invite all the candidates. What are the rules on this?

The following came over to us from Maria Garcia with the Jimenez for Council campaign:

Brady Westwater,President and all other Board of Directors of the City of Los Angeles Downtown of Los Angeles Neighborhood Council are in violation because D.O.N.E. governing rules and regulations of having Jose Huizar & Nick Pacheco both City Council Candidates for CD 14 to reserve a half hour time each to address the Neighborhood Council regarding their Candidacy for CD 14 without inviting the rest of the other Candidates giving them equal opportunity to address the Neighborhood Council!

Your Agenda is perfectly clear for the meeting on October 11, 2005 at 6:00 PM. being held at the DWP Building downtown. If the Downtown Neighborhood Council does not allow the other Candidates to speak on October 11, 2005 would be a violation. A formal complaint will be filed with D.O.N.E. and to the Ethics Commission regarding this violation.


Your next meeting that is scheduled would be after the Election of November 8th therefore you must set aside time on 10/11/05 for any other Candidate present and be recognized as well and be given an equal time! You moved Public Comments on your agenda to avoid the general public to address this issue to after Jose & Nicks presentation. City Attorney does not approve this special treatment of these two Candidates!


This is why our Candidate oppose hidden agendas and backdoor deals without do process! Neighborhood Councils is for the community not for special interest groups or individuals to abuse their powers!

Although Jimenez seems to be a nice guy - it takes much more than lawn signs to win a campaign. Look at the city ethics campaign filings, only three candidates in CD 14 bothered to file. There is plenty of opportunity for side shows, just grab a speaker's card at the next council meeting.

ANyway ,, most of the word has come to the knowledge of the other candidates by way of others who either participate on the board or who are stakeholders within the Downtown Los Angeles NEighborhood Boundaries.


One thing is for sure ,.

Brady Westwater will not change his mind on the subject of the other candidates speaking: His quote at an executive board meeting: an open meeting by the way was , that the other candidates were "not serious candidates." BY the mere fact that they did not raise a substantial amount of money.

I am sure these other not serious candidates will more than likely revcieve more than his 96 0r less votes he received when he ran for his seat on teh Downtown Los ANgeles NEighborhood Council.

I have invited , or tried to invite as many candidates to my forum Saturday October 15th at the James Woods COmmunity Center.

Come out tonite , we will have cake andd goodies while we watch the circus , who needs the movies or a play , drama tonight baby!!!!

Neighborhood Councils are required by law to invite ALL candidates to each debate they conduct. The City Attorney issued an opinion letter to that effect.

I know this from experience because when I sued the "Alliance of Neighborhood Councils" to include me in their mayoral debate, their "defense" was that they aren't actually any Neighborhood Councils in the "alliance," and that instead it was essentially two guys from San Pedro using a bank as a mailing address.

Here it is:

Why did LAUSD accept fake addresses for majority of the kids in Magnet School Program. The Magnet School seats can go to children who actually live in the LAUSD district (community). How many parents do you know, use a fake address to get the kid in an LAUSD Magnet. After school kids are picked up by their parents who drive Mercedes, SUV's, BMW's and are head out of the area, you see them head home, away from the Barrios. Sure, LAUSD Magnet schools are good enough for their preppy kids, but not good enough to live in! Some live in Covina, West Covina, Long Beach, Bell, Compton, South San Gabriel, Alhambra, and many others. Why are you letting this happen, or are we the citizens of the area to blame for not speaking out?

I know of 6 families who do this. Will I have to rat them out, I hope not, I want LAUSD to investigate and find out how many of our tax dollars are going to teaching kids that do not live in our districts.

Los Angeles city workers have abused this program, while living in middle class neighborhoods and taking spots away from neighborhood kids. USC employees have also abused this, one particular employee has 2 kids in LAUSD while living in a middle class Alhambra neighborhood, and why not send them to Alhambra? She says this is closer to her work, and the program is what she wants for her kids.

At the Roosevelt debate Robert did the opening comments by gave the mike up to another moderator for the debate. As for his son Robert Jimenez, prez of Boyle Heights Council it is one of the best and largest citywide with 51 reps. It's because of Robert's leadership that they don't waste valuable time at meetings fighting like other NC's. It all stems from the top. Robert probably isn't getting involved because he chooses his battles wisely. This isn't a major one to fight. Daddy needs to stop whining and complaining like he always does and quick wasting people's time on his nonsense. He's been labeled a crybaby.

I am having a similar situation in the valley, but in my case the NC is banning all candidates citing that to do otherwise would be "endorsing" a candidate.

Obviously that is hogwash. Neighborhood Councils should engage the electoral process full force and allow ALL FILED candidates to an equal platform.

To do less is to do nothing more than oreserve the status quo, which so many Neighborhood Councils abhor.

Remember, if you don't make yourself a political force, who will?

Lawn sign don't vote, especially the ones that Huizar is placing on homes were the residents are not even registered to vote. Take a look at 8th Street, 3/4 of those Huizar signs are placed in homes were the residents aren't even citizens. I went knocking on these doors and they all had the same story, "the landlord want put it up, what can i do?"

My understanding is that Nick and Jose requested to go before the board and that none of the other candidates made the request promptly. Heckmann will also be there. As they're not on the agenda, they can address the Council board in public comments.

I have asked Brady to allow all candidates equal time. I believe IF other filed candidates show up, that equal time MUST be provided, even if that means cutting everyone down to 15 minutes.

This problem really was the fault of the candidate who should have asked for time early but nonetheless it is easy enough to remedy.

As for his ability to handle heat, Brady was in the trenches with me on several battles, he is fair and I am certain he can handle the heat.

Yep , you are right . We didn't violate the brown act.

A: On the one hand, members of the body may provide brief informational reports on their own personal activities, make announcements, and interact with public speakers and staff for informational or procedural purposes, including the addition of an item to a future agenda. On the other hand, they may not indulge in policy discussions or take substantive action of any kind on a non-agendized item without making certain findings by a specified vote.

The first situation is one of "emergency", within the narrow meaning discussed below, that would justify a meeting on one hour's notice to the media; here the body must find by a majority vote that there exists a condition of disruption to public facilities that "severely impairs" public health, safety or both.

The more conventional second situation -- but if properly observed, still quite rare -- is where the body is able to find, by a supermajority or unanimous vote, that immediate action is required by an exigency unknown to the agency at the time the agenda was posted. Only one case has addressed how pressing such urgency must be, but it illustrates that upon challenge, courts are free to conclude that a body's voted finding of the need for immediate action was contrary to fact and inadequate as a matter of law. The California Court of Appeal has concluded that a bona fide "urgent action" situation does not arise simply because a crowd at a city council clamors for the overturn of an unpopular planning commission ruling not included on the agenda, especially where the council knew in advance that the ruling was controversial and that time was running out to appeal it (Cohan v.
