"Hurricane" Jackie Goldberg Uses Kids as Props in Campaign Against Jamiel's Law

When you look up "radical lefty" in the dictionary, Jackie Goldberg's picture is right there. The former 60s Berkeley radical turned schoolteacher, school board member, Clowncil member and then state legislator is about as hard nosed a liberal as they come. Even liberals say, "Wow, she's liberal!"

So that's why it was no surprise this morning when "Hurricane" Jackie showed up to Council Chambers with kids in tow wearing pro Special Order 40 t-shirts. Zuma Dogg on the scene phoned this tip into us; when he asked Hurricane what she was up to she replied "I'm here for the kids!"

Aren't they all?

Los Angeles Police Chief William Bratton sat down with The Times' editorial board on Monday to discuss several LAPD-related issues. Below are his remarks on the controversy surrounding the department's Special Order 40.

Jim Newton, Los Angeles Times: There's been a lot of discussion in City Hall recently about Special Order 40, whether any kind of changes are warranted to it. Does Special Order 40 still work for the department? Is there any reason to amend it at all from your perspective?

William Bratton: No … Special Order 40 is not changing one word as long as I'm chief, and I have no intention of changing it, and the Police Commission is pretty adamant about that it's worked for almost 30 years. And in terms of its intent and the language of Special Order 40, it's pretty specific … It reads, "Enforcement of United States immigration laws: Officers shall not initiate police action with the objective of discovering the alien status of a person. Officers shall not arrest, nor book persons for violations of Title 8, Section 1325 of the United States immigration code," which is illegal entry. Pretty clear language to me; I don't understand what the big confusion is about. [L.A. City Councilman] Dennis Zine evidently has some problems with this standard.

Then Item 2, "Alien arrest information - notification: When an undocumented alien is booked for multiple misdemeanor offenses, a high grade misdemeanor or a felony offense, or has been previously arrested for a similar offense, the arresting officer shall," and there's a whole series of procedures he has to go through. It's that clarification we're going to provide, because some of our officers apparently, either because they want to believe it or don't understand the guidelines, feel that they cannot ask after they've stopped somebody, arrested them, et cetera, for their immigration status …

The difficulty currently for us is technologically, when we do a wants and warrants check, NCI check, illegal immigration status, deportation orders, we open this file, another over here, so it requires going through a separate [Immigration and Customs Enforcement] file, to gain access to that information. ICE is in the process of changing so that very shortly when we do the [National Crime Information Center] check, it will have all of ICE's information included. So it'll be one-stop-shop instead of having to go to different information streams to get that information.

But the questionable issue is the idea, an officer sees John Jones and says, "I know that guy was arrested, convicted and was deported. What's he doing back here again?" Nothing to preclude that officer from going up and basically dealing with that individual, and that seems to be the issue that some of our officers have that they feel that Special Order 40 precludes that. It doesn't preclude that at all. If you have that suspicion, basically go up, you basically talk to the person … and the clarification will describe what basically the procedures that are already here and just amplify them. And then we'll train the whole department …

But the wording itself, the intent, that's not changing. And based on the majority of the City Council, despite Dennis Zine, I'm not going to change it. Zine's recommendation, where he's playing off the Jamiel Shaw plea, that we go up and basically because we suspect somebody is a gang member, the problem with that, that starts getting pretty close to racial profiling, which we seem to have had a lot of problems with in this city. So I'm not about to support something that basically is going to get us in trouble in that direction …

What people need to understand is we work very closely with ICE. I've got great relationships with ICE from [Homeland Security Secretary Michael Chertoff] on down. And ICE thinks the world of us. They think they get some of the best cooperation in the country from us. But they understand that we're not going to initiate or will not participate when they do their round-ups at the various shops downtown. We'll stand by in the event there's a disturbance, but we don't participate actively. There's no need to; I don't have the resources to.

And the irony in all of this in terms of what Zine is advocating, ICE doesn't have the capacity to arrest and hold all these people that we could basically load up on them. They just don't have it; they don't have the cell space, they don't have the capacity. Very frequently when we send in that we've got somebody, it's up to them to say let him go or hold him for us.

I'm watching the City Council meeting live and the council is catching hell from some youth justice coalition. It is a group of Hispanic youth from South Central Los Angeles. They are hammering their council members for not relating to kids being killed in the streets. They are hammering them hard for not paying attention to them when they speak (in council chambers). I think this city is slowly, from north to south, east to west, rich to poor, educated to uneducated, becoming fed up with this council. Two other notes... Jackie Goldberg gets more than two minutes for public comment. I remember a couple of weeks ago when Jamiel Shaw Sr. was speaking, Alarcon got all defensive with someone for saying the council didn't care about kids being killed on the street. Funny how you didn't hear a peep out of Alarcon today when he was hearing from a "different segement" of the public.

I think he's been standing to close to the Mayor in the public appearances and caught the lying bug. Apparently, it's incurable.

Special Order 40 "has been successful"- How is that measured at all? What is the trade-off, keeping illegal aliens gang members to make things more challenging for us?

I can see why Bratton likes to say, "We can't arrest our way out of the problem." He's never tried. What kind of law enforcement officer looks for ways to allow crime to flourish, and endanger his officers more everyday?

Remember that commercial about delayed oil changes, "Pay me now or pay me later," implying a complete engine overhaul for neglecting simple maintenance? That's what we have here. It's only going to make life worse for us all. Council and Mayor V have screwed us up with their spending and budgets and now gouge us as if we did it.

And the sad thing is, that it will totally take him by surprise because his command staff has tried to hush this up, and keep him out of the loop. Keep an eye on the news in the coming months....this will shock the hell out of you.

I am very much looking forward to some movement with respect to Bratton.

As a person who hangs with peace officers and works with peace officer agencies, it is obvious that there is so much wrong with LAPD right now. A lot of it can seriously affect officer safety, such as the changes in SWAT qualifications. NPR reported today that the first female officer under the new, easier qualifications is heading for the team. I don't know anything about her abilities. However, if she could not qualify before (and I don't know if that is true or not), you have to be concerned that her abilities -- and those of anyone else who makes SWAT under the new rules -- will put lives at risk.

Laura Chick is holding another of her Gal Chats in May -- this one is about women in public safety. Sharon Papa is on the panel. I don't know much about her, but the vibes I get in her presence bother me. She's in the tier below Bratton that you mention as insulating him.

And then there's the Special Order 40 issue...

Christine Pelisek's article on LAFD in the Weekly, about that dept and the cops are pressured to add women at all levels by the Jackie Goldbergs and Laura Chicks, old-school feminists, regardless of whether they can do the job. Most fire traineers fail during the training, and many sue for injury, and it's almost impossible to find a top female who doesn't. Cops have more jobs independent of physical force than the LAFD, but SWAT isn't one of them. I think the first woman accepted into the program comes with a long positive history, though. It MIGHT be okay if each person is looked at based on merit -- but the LAPD hiring goals make that almost impossible, the way they have quotas by race and gender for every job and level.

Zuma and Chief Bratton out meeting the "ladies", you knew that had to turn into a scandal.

Maybe AlarCON is the one exposing this scandal, is that what Zuma is mad about?

Therefore he and the rest of the LAPD officers will not do that. It has happened in the past which is why they won't do it. Ask the Personal Dept.to see their personnel records or give you stats on the amount of Officers that have been fired because of those circumstances. They will probably state the officers fired for insubordination or other obscure reasons. Bratten is nothing more than a politician who is doing the Mayor and City Council's bidding.

Bratton says Op 40 has worked for 30 years! Yes it has....it's worked to increase the size of gangs and decrease the safety of our communities. I wonder why former Chief Gates who was there at the initation of Op 40 now says it needs to be changed?

Don't swallow his or the politicians B.S., Special Op 40 has to be repealed for our safety. It affects the whole county! Listen to former LAPD Officer Dennis Zine, whose 30 years on the streets makes him more knowledgeable and qualifty on that subject than our much too highly paid politicians. How dare they minimize the inocent Jamiel Shaw's of Los Angeles who died because of Special Op 40!
