Chemerinsky Backs Chick in Battle with Delgadillo

Noted legal scholar disagrees with City Attorney's attempts to limit Controller's ability to audit.

The City Attorney has hit a major snag in his interpretation of the City Charter barring the City Controller from conducting performance audits of certain City programs.

"…I would say that is clear as a matter of statutory interpretation that the Controller can audit all City programs. The Controller can select either departments (or parts of departments) or programs for performance audits. The ability to audit the latter is entirely irrespective of where the programs are organizationally located," wrote Erwin Chemerinsky who served as Chair of the Elected Los Angeles Charter Reform Commission.

City Attorney Rocky Delgadillo recently wrote an opinion barring City Controller Laura Chick from conducting performance audits of City programs which are housed within elected officials' offices.

"As Erwin Chemerinsky's opinion underscores, the City Attorney is dead wrong on this issue. Further, it is a clear conflict of interest for him to opine that the City Controller cannot conduct performance audits of offices, including his," said Chick.

"Charter Reform was sold to the voters of Los Angeles in large part because of the promised transparency and accountability including the ability for the Controller to conduct performance audits. It is indeed troubling that those important reforms are now under attack," said Chick.

"The City Attorney requested the opinion from Professor Chemerinsky, and I ask that he now make this the official opinion of his Office," concluded Chick.

Rocky driving without insurance for a year and blaming it on his wife, who also forgot to get a license or that she had an outstanding warrant for arrest for a driving violation? Like the one that Rocky went after Paris for, with a vengeance, and it bit him in back in his own ass?

Or Cardenas using his best B-movie histrionics in city hall to convince colleagues that he's best qualified to run the gang programs, but crying that even he, a supposedly powerful Councilman, can't control his own street enough to allow his own teen son outside?

Yeah, that's a good reference.

But getting past personalities: the same old programs, often run by or hiring former gangbangers, often hadn't been audited in a decade, and some workers still play it both ways, using it as a power base in the community.

The Police magazine has a recent feature on the history of EME which reminds us that back in the mid- seventies, a "made man" of EME who ran Community Concern and other anti-gang programs -- but was still an active member, and the EME even used company cars to make some 33 gang hits, usually pulling victims into the car and killing them there -- actually ran against Art Snyder for City Council, and came close to winning.

Played the race card, community activist card, "I know what's best for my people" card. Snyder managed to win and pull funding from Community Concern and one other project.

We NEED a broad range of eyes on these programs, from Chick to the Mayor to Bratton. (But they've got to admit we've got major race gang wars on our streets -- realities and transparency are more important than trying to cling to their own records as presiding over an alleged drop in gang crime. Denying it will hurt them more.)
