Mayor Sam's Hotsheet for Thursday

The popular Spanish-language radio broadcaster known as "El Cucuy" was booked today on suspicion of making criminal threats in connection with a New Year's Day confrontation with police, police said. Maximo Almendares was released after posting $50,000 bail at the Los Angeles Police Department's Devonshire Station just before 5 p.m., police said.

No this time it looks Joe B. has got himself some national attention by posing some teenaged Home Depot protestors for the camera and getting the photo published in the socialist rag "The Nation." With all due respect for Joe B. this tells you a lot where the anti-Home Depot people are going. Moderate, conservative and Republican supporters of the anti-Home Depot cause may want to take a second look at their strange bedfellows.

A nationally recognized charter school in South Los Angeles has defaulted on a $9.9 million loan extended by the Los Angeles Unified School District using voter-approved bond funds, documents and interviews show.

The Accelerated School, an elaborate, high-tech campus where Mayor Antonio Villaraigosa delivered his State of the City address last spring, made a $200,000 payment about two weeks ago - but only after district officials received a memo alerting them the campus was in default. The school previously had made two payments totaling about $1 million, the last in October 2005.

"They made a payment, but they're still way behind," school board member David Tokofsky said. "Why we haven't foreclosed, I don't know."

Meghrouni said she believes the loan, made in June 2004 using revenue from voter-approved school construction bonds, is the only one of its kind extended by LAUSD to a charter school.

Although the school has close ties to the Mayor's Office, there is no indication that Villaraigosa has been involved in the loan or in the renegotiation discussions.

A judge who ruled that Mayor Antonio Villaraigosa's plan to reform Los Angeles public schools was unconstitutional said Wednesday she could decide next week whether the city can implement the law while it appeals her ruling.

The Mayor's Office hopes an appellate court will overturn Superior Court Judge Dzintra Janavs' Dec. 21 ruling that Assembly Bill 1381 - the education reform bill signed into law last year - is unconstitutional.

The law was due to take effect Monday, but the Los Angeles Unified School District filed a lawsuit to block it.

On Wednesday, attorneys for the Mayor's Office argued that the city should be able to implement the law pending a decision by the appellate court.

But L.A. Unified officials, who called the hearing so Janavs could clarify her ruling, said the law should not be allowed to take effect until the courts resolve its constitutionality.

"It would be chaos now to put part of this into effect only to have it possibly overturned later," said Kevin Reed, the district's general counsel.

Janavs set a hearing for Jan. 11 to determine whether the city could implement the law or if it would have to wait until an appellate court rules on its constitutionality.

Thomas Saenz, the mayor's chief counsel, said their appeal effectively stayed Janavs' ruling, so AB 1381 essentially took effect Monday. The Mayor's Office has been moving forward as if the law were in effect, he said.

They are hiring an education team and selecting clusters of low-performing schools for the mayor to personally oversee, one of the powers the law specifically grants L.A.'s mayor.

But Villaraigosa is not set to take control of the clusters until July. Under the education reform law, the first major shift in the way the district is governed would be the superintendent assuming greater powers - those previously held by the school board.

That puts the ball in the court of newly appointed Superintendent David Brewer III, Saenz said.

"It's an unusual situation. We believe the law has taken effect ... and it takes a superintendent who wants that power and authority to test it," he said.

Brewer could not be reached for comment Wednesday, but a key aide said too many legal questions remain unanswered for the superintendent to take a decisive step at this stage.

"The superintendent and (school) board can't move forward based on assumptions," said Don Davis, Brewer's chief of staff. "AB 1381 had been ruled unconstitutional. ... Given that, it would not be prudent or responsible for the superintendent to move forward under whatever additional powers AB 1381 purports to give."

Each time a woman decides to go jogging, she must be aware there were 872 rapes in Los Angeles last year. By the way, there were only 200 arrests for rape in 2006! So ladies, as you decided to go for a run in the park or LA River, remember 672 rapists are still loose!

There were 13,635 aggravated assaults in 2006. That is quite an impressive drop since 2004 when the number was 25,009. But hold the presses, in 2004 assaults against women and children were counted in the reporting statistics!

Want to cut the number of aggravated assaults almost in half? Then don’t count the assaults against women and children! Plus you can blame the FBI Reporting Guidelines…

At a recent Neighborhood Council meeting I asked the Senior Lead Officer why the LAPD does not included these assaults in the LAPD Crime Statistics. The response left me speechless. They do not count them because they have no control over them.

What other crimes are not counted in the LAPD Stats? Does anyone have the stomach or backbone to give us the real facts about crime in Los Angeles?

I wonder if it has already reached the point where there is not even a clear definition of what a crime is. If it is Federal then is it counted? Bank Robbery- yes but something having to do with illegal immigration-no.

I guess it depends on what the definition of is, is…

Anyone familiar with a 12 step program knows Step 1 is admitting there is a problem and whose problem it is.

But for those politicians who are addicted to money and power, the truth is only a liability.

The Department of Homeland Security just released a list of the major cities most prepared for an emergency. Los Angeles did not even make the farm team.

So Mr. Mayor, Chief Bratton and the folks at the LA City Council, your being in denial may make you look good on paper, but it escalates the bloodshed and crimes against innocent victims you swore to protect.

Just an observation and a hint of things to come.

Yet, they call 911 which makes it a reporting crime. Also you're blaming law enforcement on the Homeland Security issue. If you would have done your homework you would have learned that its not LA city but the ENTIRE LA COUNTY which covers a lot more miles and Baca is included. The reason LA didn't get a good grade is because they need $600 million for the communications to be implemented. The Feds aren't giving LA the money.
