EAA Getting A Little Upset
The Engineer and Architects Association continues to turn the heat up on the Mayor. Tuesday, they visited the City Council. In their own words, here is what happened:
This morning approximately 350 EAA members appeared in City Council chambers to seek redress from the City’s government regarding not being offered fair Memoranda of Understanding. This comes after 23 months of being singled out by the City’s government for disparate treatment. When Villaraigosa showed up for a prearranged photo-op, EAA members began chanting “Equal Pay for Equal Work”. This disrupted the Mayor’s photo-op. After only 5 minutes Los Angeles police officers handcuffed EAA Executive Director Robert Aquino, Assistant Executive Director Patricia Loparo, EAA Staff Coordinator Angel Calvo, and EAA Staff Coordinator Patrick Shannon and placed them under arrest. They then marched the four out of the chambers into a holding area, and started to arrest other EAA members in the council chambers. Apparently the Mayor and Council President realized what a debacle they were about to create and backed down and did not process any other arrests. The four EAA officials were charged with unlawful assembly while being held in holding cells beneath City Hall. They were later released.
There can be no doubt now that Mayor Villaraigosa is a hypocrite. He only advocates for labor when he needs money for his elections and he only spews the ACLU line when it supports his free speech.
EAA’s legal counsel is processing a claim on behalf of the organization and the individuals that will be presented to the City with lawsuits to follow.

"Equal pay for equal work" is a concept we all admire. It hasn't been the case for over 50 years when it comes to DWP salaries and other non revenue generating L.A. city departments despite competing for the jobs on the same Civil Service exam. Marvin Braude (bless his soul) tried to address the differential but fixing it was cost prohibitive (according to the CAO)and so the council adopted a single salary setting policy in the late 80's. For a time everyone, including DWP, recieved the same pay increase. The differential was still there but it wasn't excacerbated.
Then the council changed and in the latest contracts the single salary setting policy was abandonded. Now the EAA is attempting to get it back.
FYI - The MTA contracts expire June 30 and the unions (Drivers and Mechanics)want the same salary package the DWP workers got. Also, the PPL is in negotiations seeking the same package.

First how can the council and Mayor approve the 28% raise to the DWP and turn around and tell EAA that we have to live within our means. Does this mean some workers are better then others.
Second, now the residents of LA have to pay a higher rate for DWP services in order to pay for the 28% increase. So not only am I not get my raise but I have to pay more money to the DWP.
So to add things up
(-3%)+ (- DWP Rate increase) = within our means (of being broke)
If the Mayor and council will not listen then let us take to the people. Since we are also the people I hope they do not forget that they work for us. We the residents of LA can vote and demand changes.

Someone should get off their ass and file a Unfair Employee Relations Practice (UERP) with the Employee Relations Board (ERB) claiming that EAA has not lived up to the provisions of their own MOU. EAA has failed supply the City Clerk with a detailed financial disclosure for so long they probably forgot to ask Aquino for one. According to MOU 1, Article 2.9 para D, it states "The organization shall keep an adequate itemized record of its financial transactions and shall make available annually to the City Clerk, and to all unit employees, within sixty (60) calendar days after the end of its fiscal year, a detailed written financial report thereof in the form of a balance sheet and an operating statement, certified as to its accuracy by its president and the treasurer or corresponding principal officer, or by a certified public accountant.”
Do you think for a New York minute Bob wants you to know how he’s spending the dues? Its apparent legal counsel has been getting rich with their regular appearances at the ERB. But the members should be able to go down to the City Clerk office and get the latest copy of EAA’s financial report. If not then how can they expect to be taken seriously when others breach the MOU and they cry for blood. It works both ways Clown Aquino.

Interesting post. I reviewed the MOU and that's standard wording for the other EAA MOUs. I, for one, would like to see how our money has been spent since Bob Duncan got canned. A UERP is a little lame though - even if an arbitrator ruled in favor of the employee(s), all that would happen is the ERB would publish a cease and disist order. There's not bit in those.
More appropriate would be a lawsuit - that would force a solution and disclosure. However, the union dues they would earmark for this action would smother the average wage earner. Bob would pull out the stops - plus he'd have to pay for that horse head plus delivery.

Whether or not City employees are underpaid isn't the issue, and it never was. Anyone finding out that a colleague was making a hell of a lot more for the same work (or less work) would be just as pissed as the EAA members. If you said you wouldn't be than you're lying SOB.

I would gladly give more money in dues to EAA. This is the first time in my 23 year city career that my union (I am proud to say MY union now) has stood up for me. I fully understand that to give up now would mean getting 0 % for the first year and a shitty COLA that leaves me further behind than my counterpart at DWP. By the way, I have taken the time to go the EAA office and view the audit and I am happy with what I saw. EAA is using my dues money wisely and judiciously. Keep up the good work Bob and thank you for having the backbone to stand up for us. You have my full support AND that of my many co-workers!
