Good Saturday Morning from the busy sidewalks of CD 14

Councilman Huizar's vision of economic growth sprouting up on sidewalks district wide.

While a certain blogger goes blogasmic over his consultant of choice latest smear, enterprising constituents are contributing to the underground economy of CD 14 by using the public sidewalks in what is a common scene within Councilman Huizar's fiefdom. As a bloggin public service, we bring you the issues on why our current councilman is hiding behind a "badge of a fallen officer", rather than discuss the real issues.

WTF???? How unfortunate that the CD14 race on other blogs are much more intelligent and speak to the issues. Here the Huizar groupies post ridiculous attacks on Mr. Martinez instead of focusing and telling people why they think Huizar should be re elected. It shows the mentality of the Huizar camp. THis is a huge issue in Boyle Heights. Huizar and his staffers have used threat of intimidation especially with business owners. You either put the sign in your store front window or else? Antonio used such tactics. I don't support Huizar like many constituents but I have legitimate reasons not immature rantings like his camp.



1. He lied about the trash fee hike and conned the public


2. He abused CLARTS FUnds and uses it to pay exorbitant salaries to staffer over $125,000 each.


3. He named the corner of 7Th & Broadway after a family Deljiani who gave him campaign money and is helping them buy a garage


4. He allowed businesses in Olvera Street to pay far little for rent for years while everyone in downtown is hurting


5. Instead of fund raising for more important causes he's raising $100 million for a Street Car


6. He voted to give DWP Managers back pay of $5 million with his colleagues


7. He voted for a pay raise for DWP


8. He FAILED to show up to City Council because he was at photo op at restaurant opening


9. He is referred to in many news articles as the "laziness" of members


10. He refuses to respond to the missing $1.5 MILLION CLARTS FUND


11. He has been investigated by the FBI and ex staffers are saying its not over


12. He criticized officers to the media without knowing facts and its all over the Internet


13. He supports liquor licenses in CD14 knowing full well owners always take advantage of minority communities.

Yea that's right 1:22, tourists from all over the world, Olvera St is unique to LA and has been a joy to children who can study the history of LA and at the same time buy curios and other junk that they remember fondly the rest of their lives. Those merchants pay rent and have been paying for many years, but for some short sighted entrepreneurial politicians, who might want to "claim jump" Olvera St and turn it into an "International Marketplace" or "Little Hong Kong" by jacking up rents and forcing those multi generational family owned business's out due to extravagant rent increases is ludicrous and short sighted.
Get back in the alley with the other bong-meisters and leave Olvera St alone.

DOWNTOWN LOS ANGELES - Merchants along Olvera Street last week initiated a legal process that could lead to them suing the city for $52 million. The action comes two months after they rejected the latest rental agreement offered by the city.

Paul Hamilton, an attorney who represents about 45 merchants, said a claim was filed against the city Jan. 31. He said the claim is the first step before filing a lawsuit.

Officials with the City Attorney’s would not comment on the claim. Calls to the office of Councilman José Huizar, whose 14th District covers El Pueblo, were not returned.

In the claim, the merchants say the dispute stems from the city and the El Pueblo de Los Angeles Historical Monument Authority’s denial “of the Olvera Street Merchants’ rights to a long term lease and fair and reasonable terms.”

The claim points to Proposition H, which was approved by voters in 1992. The merchants say it gives them the right to leases such as the 55-year terms signed by 17 tenants more than a decade ago.

The claim says tenants “will suffer damages in excess of $52,375,00 over the remaining 43 year lease terms,” which includes loss of profits, new rent they would have to pay if they are evicted, relocation costs and attorney’s fees.

However, city leaders have in the past disputed the terms of Proposition H. In a letter sent to Huizar last year, City Attorney Carmen Trutanich stated that under Proposition H, the city is permitted, but not required, to enter into long-term concession agreements.

“Nothing in the language of Proposition H or in the current Charter, requires any particular length of time for a long term concession agreement,” the letter stated.

The claim comes a year after the civilian El Pueblo Commission approved new rents for merchants based on a study commissioned by the city. The report recommended rents of $2-$6.50 per square foot.

The merchants countered with their own study that suggested rates of $1.20-$2 per square foot for merchants in most of the standalone businesses.

Last April, the city’s new rents went into effect. However, more than 40 tenants have paid only their old rates, which city officials say costs them about $72,000 per month.

There have been numerous efforts to resolve the matter, including a failed mediation attempt in the summer. The most recent offer by the city called for 20-year leases with an option to renew for another 20 years, at rates up to 30% below what the city sought in April.

D.A.'s office says there is enough evidence to charge LAPD's DAVID KALISH in two alleged molestations, but the deadline has passed.

There is sufficient evidence to charge Los Angeles Police Deputy Chief David Kalish with molesting two teenage police Explorer Scouts more than 20 years ago, but legal deadlines for prosecution have passed, according to Dist. Atty. Steve Cooley's office.

Prosecutors have rejected a request by internal affairs investigators to file criminal charges against Kalish, the highest-ranking openly gay LAPD officer and a candidate for chief last year.

Prosecution is "precluded," by a U.S. Supreme Court decision last summer that struck down California's attempt to bring to justice older cases of sexual molestation, according to a memo by William Hodgman, head of Cooley's sex crimes unit.

"It's a travesty that Kalish was able to evade the law on a technicality," said Oakland attorney Todd A. Walburg, who represents two of the men who have filed claims alleging they were molested by Kalish.

"Now, while Kalish lives his life as a free man, he has left several victims behind who are in constant pain from molestations that occurred when they were teenagers," Walburg said.

The three-page memo gave brief descriptions of incidents without providing detailed accounts of witness statements, corroborating evidence or potential problems with the case beyond the Supreme Court case.

Sex crimes prosecutors said they reached their decision based on reports and witness statements submitted by the Internal Affairs Group of the Los Angeles Police Department, and testimony before a Los Angeles County Grand Jury between April and June.

Walburg expressed disappointment that the criminal case was upended by the Supreme Court decision, but said at least the public could see there was enough evidence to warrant felony prosecution.

Criminal charges based on 2-decade-old conduct normally had been barred. But in the mid-1990s, the state Legislature extended the statute of limitations in cases of serious sexual misconduct in which there was corroborating evidence.

The extension of the deadline on sex crimes allowed prosecutors to pursue cases against hundreds of alleged molesters from Roman Catholic priests to teachers and parents.

A five-month LAPD investigation clearly indicated "that the department believes there is substance to those charges," Chief William J. Bratton said in March.

It was not the first time prosecutors have reviewed allegations against Kalish. In 1996, an LAPD police sergeant made a series of allegations against Kalish after he was accused of falsifying overtime. The sergeant accused Kalish of falsely reporting police badges as missing, taking gifts from an informant, and drinking and driving, according to court documents.

The district attorney rejected the allegations after an LAPD internal affairs probe in 1997, citing insufficient evidence.

What an example? And, yes, he should be at City hall more often, especially for staff meetings.

In 1985, the City became the administrator of El Pueblo. In 1992, the citizens of Los Angeles passed, with City Council support, Proposition H which was intended to protect the Merchants’ right to remain as tenants on a long term basis. Proposition H stated purpose was to “preserve the cultural integrity of the City’s birthplace and protect the merchants currently operating businesses on Olvera Street through City provided long term leases which are not subject to competitive bidding. In furtherance of this mandate, Proposition H acknowledged that “Olvera Street has been a unique historic, cultural and social resource. Its merchants have been bringing Mexican traditions to the community for over 80 years. Merchant commitment and involvement have helped preserve this historic landmark.” Over 2 million people visit El Pueblo every year.

In implementing Proposition H, the City Council directed that its El Pueblo overseeing commission (“Monument Commission”) “enter into long term concession agreements with the existing merchants on Olvera Street without any arbitrary or artificial limit for their duration, but rather with their duration to be determined based on what is negotiated as being fair and reasonable so as to treat all merchants equitably regardless of the size of the merchant’s business.”

In 1999, the City Council passed, by unanimous vote, a resolution that directed the Monument Commission to prepare a Master Lease for the Merchants whose essential terms were:

•Term of 55 years.
•Rental rates could be adjusted every five years at the lower of the CPI Index, or comparable market rents.
•All Olvera Street merchants would pay a common area maintenance (CAM) fee to the City.
•The City would provide, at its expense, certain capital improvements including a new adjacent to Olvera Street parking structure costing $5,000,000 and rents could not be increased until this parking structure was completed.


Now the powers that be want an additional million a year and back rent of almost 2 million from these merchants at Olvera St.
Smacks of unrestrained capitalist pig meat.

This is the city. Los Angeles, California. I don't really live here, but I used to carry a dead cop's badge (until I got caught and impeded an investigation).

It was a Saturday in August, the beginning of election season in Los Angeles.

The fact that it was the badge of a slain police hero only compounds the crime to the point of being ghoulish and horrendously disrespectful. If you think that doesn't make the actual CRIME (fact) any more criminal, okay. Seek whatever comfort helps you cope.

But realize also, that all the pro-Rudy spin that his CRIMES were SO long ago... that this "troubled boy" (actually an adult in his mid-20s), LEARNED from his past mistakes... and STOPPED commiting crimes DECADES ago, just got flushed down the toilet.

And this is WHY he doesn't promote his time spent as an LAPD volunteer, but mentions FAR more often volunteer work that is much less impressive and that he spent far less time at.

Simply put, because he got CAUGHT once again -- LONG after he had supposedly "learned" his lesson.

Blame that all on the people who only released the police report - fine.

But, I'm glad they did. (I'd actually heard worse stories about it - better to quash the escalating rumors with facts).

There is simply no evidence that Martinez knew. This is just spin from Parke Skelton, to use the memory of a slain, young policeman for political gain.

If Huizar had received the Times endorsement instead of Martinez, we would not be discussing this issue!

The Olvera Street leases were never meant to be in the best interest of the City. They were meant to benefit a few latinos connected to City Hall. I bet Gloria Molina would have some insight on this.

Why were the City employees reporting to the CHIEF LEGISLATIVE ANALYST during construction?

I think if you look at the books, you will find over $10 million transferred from the City Hall Restoration Project to Olvera Street. This was at the same time The City Hall construction budget was spiraling out of control without explanation.

All work on the plaza was to be completed before a visit by Bill Clinton. He was to use Olvera Street to Address potential Latino Democratic voters.

What was really going on here? And no rent increases for the leaseholders?

Olvera Street is too important as a historical center for the City to be left in the hands of the mob.

Separate Huizar from CD14 or Separate CD14 from Olvera Street. Either would be an improvement.

Nobody has suggested Pacheco asked any of his staff to contribute to the Martinez' campaign. Nobody has suggested Pacheco put pressure on them to contribute to the Martinez campaign. Nobody has suggested that Pacheco reimbursed anybody.

Huizar suporters want to believe that. Huizar supporters are spreading rumors to that effect. But none of it is true. And no news account has ever suggested Pacheco did anything wrong.

Just the same old dirt throwing and rumor mongering that one expects from Huizar supporters.

When are we going to get Huizar supporters extolling their candidates virtues? Or is it to be the same old character assassination campaigns we are used to from Huizar. What a waste of a Princeton education.

OF COURSE t was "Tricky Nicky's" doing.

It has his muddy footprints ALL over it. They wouldn't have done this for ANYONE but him.

Huizar doesn't need his supporters explaining his track record - especially HERE, where the myopic little SPOTS would twist every good deed into some form of "corruption" No, he's doing an EXCELLENT job of it all over the district and all but a small minority of people in CD14 are VERY saftisfied with his work, and will -- just as they have TWICE before with MAJOR landslides -- re-elct him for another 4 years.
