Does Obama Support Rights of Aborted Children "Born Alive?"

Before I go further into this issue, I need to make it clear that I am pro-choice though am no fan of abortion. I believe in recent years we've made significant strides in changing the cavalier attitude of abortion as birth control of the 70s and 80s. I do believe that the further along in the term of the pregnancy abortion should be progressively restricted and the horrific practice of late term abortions (with exceptions for life of the mother) should be ended.

That being said though there is a right to choice, if a child survives an abortion there must be protections for the child who is now a living human being. Barack Obama seems to have trouble with this issue considering votes he has made in the Illinois State Senate and comments made during a candidates forum held at the Saddleback Church earlier this year

The Federal Born-Alive Law passed by Congress in 2002 and signed by President Bush extends legal protection to children born alive following a failed abortion. The law is based on the definition of live-birth as set by the World Health Organization in 1950. The Federal law received unamious support of the Senate including that of Democrats such as Majority Leader Harry Reid.

In a series of bills in the Illinois State Legislature as a State Senator, Obama voted three times against an Illinois version of the Federal Bill that was exactly identical to the Federal law. Obama's reason for voting aginst the state bill the first two times was that it did not contain protections for the landmark Roe vs.Wade decision that legalized abortion rights.

Yet when the bill came back a third time to the Illinois Senate - with the protections as in the Federal bill - he still voted against it.

The Obama campaign tried to spin the vote based on the claim that the Illinois law was not identical to the Federal law. The non-partisan group FactCheck.org however says this is not true, that by the time the bill came up in committee in the Illinois legislature it contained indentical protections to the Federal law. Once this was clear, Team Obama changed their story again now saying that even though the law had the same protections for Roe as the Federal bill, he still felt it would undermine abortion rights.

You have to wonder where Obama's values are here. When the abortion rights activist group NARAL was neutral on the Federal bill - and it received the votes of folks like Dianne Feinstein and Teddy Kennedy - is Obama out of touch even with his own party?

If you want to accuse Obama of pandering to a pro-choice group that is a fair discussion but the FACT is he doesn't support redundant laws, or laws that extend protections beyond where they are now.

Illinois law has long stated that if an abortion is performed when the fetus is deemed to be viable, the doctor must:

- Have in attendance a second doctor who can immediately take over care of the child if it's born alive.

- Use every available means to keep any born-alive child living and healthy.

To do otherwise constitutes a Class 3 felony, which carries a sentence of two to five years in prison. That's been the law in Illinois since 1975. What Obama voted against was legislation that would have extended the law's protection to any aborted fetus that shows any sign of life, even if doctors are certain that it cannot survive.

Who support that kind of suffering?

The fact is that a fetus born alive IS PROTECTED and to say anything less is an utter falsehood.

You're following the Obama line of calling any criticism of Obama "inflammatory," "divisive," "racist," etc.

The bottom line is that three times Obama voted against a law that aligned with Federal law supported by Hillary Clinton, Teddy Kennedy and Dianne Feinstein.

Even FactCheck.org, a non-partisan organization, says that Obama's campaign spun his vote twice when his first explanation was shown by FactCheck not to hold water.

My concern is with Obama's extreme view on the issue which shows he's out of touch on the abortion issue, even with his own party.

I'm pro-choice but I'm not pro-abortion. Adoption should be an alternative and late term abortions should only be an option when carrying the pregnancy to term is going to harm the mother.

God took out NAZI Germany for murdering just 7 million people; I can't imagine what He's going to do to us.

That being said you've completely not responded to my case that Obama 1) is out of touch with even his own party on the "born alive" issue (which by the way has no impact on abortion rights) and 2) That Obama's judgment and character comes into question when he's spun his vote 2-3 times when confronted by a non-partisan group like FactCheck.org.

You don't even read that I'm pro-choice and that I'm opposed to schemes like Prop 4.

So have fun attempting to pigeon-hole or parroting the Dummycrat line.

Perhaps soon you'll figure it out.

The Congress never took any position on the Illinois legislation because it would have expanded the existing Federal law.

Obama says determining who should live and who shouldn't is above his pay grade.

That's where the concern lies. Obama is simply wrong on this issue and efforts to continue to spin and re-spin are useless.

Your position (assuming you agreed with the Illinois law) is akin to those screaming about the Terri Schiavo case. It would force doctors to keep a brain-dead fetus with o% chance of survival alive. Let us be clear, Federal law demands life-saving measures be taken when a child is born alive. YOU are spinning when you conflate the Federal law and the Illinois law which are, in fact, different.

Life must be determined by doctors with degrees, not hyper-partisans trying to score a political point.
