Where's Rocky?

While the City Council pondered the $2.7 million tentative settlement with dog food guy, where do you suppose the City Attorney was? And now that they've rejected the proposed deal, and the case is headed for trial, where do you suppose he is?

If you were from any other City, your answers would be: i) in Council Chambers, explaining the pros and cons of the settlement; and ii) back in his office, preparing this high-profile case for trial.

But since you're from L.A., it will come as no suprise to learn, as reported by John and Ken this afternoon, that Rocky Delgadillo is (insert drum roll) . . . in MEXICO taking SPANISH lessons!

And that, my friends, is the CARTOON DU JOUR: WHERE'S ROCKY?.

It's too bad there's no one here in L.A. who speaks Spanish, nowhere to learn that language....

Mebbe he wanted to learn formal street spanish, versus informal.

for us old timers in CD 14. We all remember when ex councilman Art Snyder went to MEXICO to learn Spanish and learn the language quite well. When Steve Rodriguez ran against him in the recall, Rodriguez could not communicate as good in spanish as Snyder.

why would mayor want 60 hour advance notice?

1. cancel speeches
2. prepare police
3. feed the cats
4. feed some mo' cats
5. feed ghetto cats
6. still feed sacramento cats
7. they scare him
8. he is humiliated by union
9. can't face the truth

Professor Moore,

With all your trial experience, please explain to all of us the details of the Richard Nagatoshi/LAPD settlement from 2004. I believe, as was stated in the LA Times today and also in Council chambers yesterday - he won around $4 million for racial discrimination, harrassment, and retaliation. Do lawyers look for precedents when trying their cases? Certainly, each one is different. Still, I wonder. And did you happen to read the Dave Z. piece in the LA Weekly today? I wouldn't hold my breath for a trial...

Laura Chick did one of these Spanish language junkets years ago when she was on the council and the DN called here on it -- hard! That was before they decided to buy into all her crap without question to get rid of Hahn.

Anon 6:12 PM - You forgot a few reasons why AV wants a 60-hour notice:

10. feed dogs (Pierce not included, he can find his own food)

11. buy airline ticket to learn Spanish in Mexico

12. if blacked out, buy airline ticket to learn English in England

13. catch up on sleep

14. buy more breath mints

15. acquire another mistress (how many does he have now - I lost count)

16. clean more toilets

17. visit his childhood friend Vignali

18. go to confession and not say a word

19. finish his degree in rocket science

You'd have to give me more info re the facts of that case.

As for dog food guy, I think the City needs new trial counsel RIGHT NOW. Anyone who would recommend $2.7 million doesn't have the you-know-what's to explain to a jury what a steaming pile this case is.

I've seen it before in my practice. I had this case for a restaurant where two guys on bikes ran into each other, and one broke his hip. Hip guy sued everyone: the restaurant, the other bicyclist, the other bicyclist's employer, and the shopping center.

Everyone settled but us. Everyone paid the guy a freakin' fortune. We refused. I tried the case, and it took the jury maybe four hours to conclude it was bike guy's own damn fault, not the restaurants.

For cases like this, you need real TRIAL LAWYERS -- lawyers who actually try cases -- not LITIGATORS, lawyers who handle lawsuits, but never actually make it to trial.

I try cases. I'm telling you, based on my experience, this case is a dog. My focus on the case would be damages, and I would, if the Court allowed me, eat a can of dog food in closing argument. I would keep it short and simple, so the jury would stay focused on how this is totally an "Emperor has no clothes" deal.

End of the lessson for today. Your homework: write an opening statement, to last no longer than two minutes.

P.S. Strictly speaking, the outcome of a jury trial is not "precedent." Rather, that term refers to case law, i.e., published opinions of courts of appeal.

P.S. One very disturbing thing I heard today from Rocky's spokesman on the radio was his assertion -- admission? concession? -- that Laura Chick's audit of the fire department, along with other evidence of discrimination, would be admissible at trial.

I thought to myself, "Is he @#$%^ing kidding, saying that at all, much less on the RADIO?!"

First of all, it should not be admissible at all. Second, why in God's name would you concede that at all, without even fighting it? And even if the trial judge rules against you, you don't concede it; rather, you reserve your right to appeal the issue.

Walter, your last comment was right on the money. What kind of legal representation is the City hiring nowadays? A bunch of amateurs?

It's NEVER a good idea to give one's opposition more ammunition they can use to defeat you in court, especially concessions before a case goes to trial! Even writers for TV courtroom dramas know that!

We're stuck with Rocky.

At least Bamattre won't be in charge anymore.

Check in with Chief Douglas Barry with your questions.

What will he do with all the other pending litigation?

Brenda Lee is right around the corner.

If this case goes to trial (which I doubt), I hope the focus is properly on the plaintiff's character, personal and occupational background, history of pranks etc. I wonder how thorough of an investigation has been undertaken by Rocktard in this regard.

One of the very best things to happen in this mess is that, very publicly, Antonio was shown to not be in control of the City.

Antonio has irrevocably lost the black vote, and that means he is OUT as Mayor in two years and, therefore, not going to have a chance at being Governor.

This whole thing is a blessing in disguise: Antonio was exposed.

Antonio is firing Bamattre today and will have his big photo op. Everyone should e-mail johnandkenshow.com. If Bamattre goes then like the DN says other heads should roll at city hall. Rocky comes to mind immediately. What a moron atty. he is!!! City council embarrassed this entire city and should be reprimanded. John & Ken was making fun of Rocky's rep who was giving away the kitchen with his stupid comments. Other attys. stated that Pierce only claim can be retaliation but when you have his photos that's a hard sell. He wasn't demoted, wasn't passed up for promotion.

Tony Villar couldn't pass the bar after 4 tries and has a GPA of 1.4!!!! And he's the leader of the pack!!!!!

Citizens of LA...take heed!!!!! Get rid of these brainless nitwits!!!

I think you're right, but who challenges MAV in 2009?

Bitter Bernie? (with heavy baggage from Rampart?)

Doggy Delgadillo? (he'll need all the spanish he can learn to get the hispanic vote from MAV)

Very interesting . . .

Since Rocky's mother is white it would make sense he doesn't know Spanish. But, don't you think the kid allegedly from the "barrio" would have realized the need for Spanish proficiency or fluency long ago? Antonio sure realized it as did Gil Cedillo.....both of whom attended the Cuernavaca language school.
