Where's Rocky?

While the City Council pondered the $2.7 million tentative settlement with dog food guy, where do you suppose the City Attorney was? And now that they've rejected the proposed deal, and the case is headed for trial, where do you suppose he is?

If you were from any other City, your answers would be: i) in Council Chambers, explaining the pros and cons of the settlement; and ii) back in his office, preparing this high-profile case for trial.

But since you're from L.A., it will come as no suprise to learn, as reported by John and Ken this afternoon, that Rocky Delgadillo is (insert drum roll) . . . in MEXICO taking SPANISH lessons!

And that, my friends, is the CARTOON DU JOUR: WHERE'S ROCKY?.

for us old timers in CD 14. We all remember when ex councilman Art Snyder went to MEXICO to learn Spanish and learn the language quite well. When Steve Rodriguez ran against him in the recall, Rodriguez could not communicate as good in spanish as Snyder.

With all your trial experience, please explain to all of us the details of the Richard Nagatoshi/LAPD settlement from 2004. I believe, as was stated in the LA Times today and also in Council chambers yesterday - he won around $4 million for racial discrimination, harrassment, and retaliation. Do lawyers look for precedents when trying their cases? Certainly, each one is different. Still, I wonder. And did you happen to read the Dave Z. piece in the LA Weekly today? I wouldn't hold my breath for a trial...

As for dog food guy, I think the City needs new trial counsel RIGHT NOW. Anyone who would recommend $2.7 million doesn't have the you-know-what's to explain to a jury what a steaming pile this case is.

I've seen it before in my practice. I had this case for a restaurant where two guys on bikes ran into each other, and one broke his hip. Hip guy sued everyone: the restaurant, the other bicyclist, the other bicyclist's employer, and the shopping center.

Everyone settled but us. Everyone paid the guy a freakin' fortune. We refused. I tried the case, and it took the jury maybe four hours to conclude it was bike guy's own damn fault, not the restaurants.

For cases like this, you need real TRIAL LAWYERS -- lawyers who actually try cases -- not LITIGATORS, lawyers who handle lawsuits, but never actually make it to trial.

I try cases. I'm telling you, based on my experience, this case is a dog. My focus on the case would be damages, and I would, if the Court allowed me, eat a can of dog food in closing argument. I would keep it short and simple, so the jury would stay focused on how this is totally an "Emperor has no clothes" deal.

End of the lessson for today. Your homework: write an opening statement, to last no longer than two minutes.

P.S. Strictly speaking, the outcome of a jury trial is not "precedent." Rather, that term refers to case law, i.e., published opinions of courts of appeal.

I thought to myself, "Is he @#$%^ing kidding, saying that at all, much less on the RADIO?!"

First of all, it should not be admissible at all. Second, why in God's name would you concede that at all, without even fighting it? And even if the trial judge rules against you, you don't concede it; rather, you reserve your right to appeal the issue.

It's NEVER a good idea to give one's opposition more ammunition they can use to defeat you in court, especially concessions before a case goes to trial! Even writers for TV courtroom dramas know that!

But, don't you think the kid allegedly from the "barrio" would have realized the need for Spanish proficiency or fluency long ago? Antonio sure realized it as did Gil Cedillo.....both of whom attended the Cuernavaca language school.
