Open Thread for Mond... errr, Tuesday
Long weekend comes to a close today with OBama's nomination for the Supreme Court earlier and the announcement of the California Supreme Court's decision on Prop 8 at 10am.
Locally, we have signs signs everywhere signs on the City Clowncil agenda.
Ron Kaye has the details of serious election irregularities in the CD 5 runoff.
And Matt Dowd is still speaking in public comment this morning.
BREAKING: Looks like Prop 8 stands, but existing marriages remain valid. Nothing too surprising, sadly.

All I have heard people complain about is how the Attorney General never goes after anyone for corruption. Now he is, but besides a story buried on Saturday in the newspaper, it may as well be a tree that falls in a forest that no one hears. Has anyone noticed that the Attorney General issued subpoenas of Friday? That's bigger than a lactation class! Not a thread? Not a comment? I guess it's no biggie.

Subpoenas issued in pension fund corruption investigation
Atty. Gen. Jerry Brown is looking into 'placement agents' who help secure pension fund investment contracts for clients, often in return for millions of dollars.
By Michael Rothfeld and David Zahniser
May 23, 2009
Reporting from Los Angeles and Sacramento — An ongoing investigation into pension fund corruption across the country intensified Friday as California Atty. Gen. Jerry Brown directed subpoenas at politically connected firms and individuals, according to sources familiar with the investigation.
Brown issued the subpoenas as part of a probe into "placement agents" who help secure pension fund investment contracts for their clients in return for large sums of money, often millions of dollars.
The subpoenas seek information on the use and disclosure of placement agents and potential conflicts of interest, said sources who spoke on the condition of anonymity because they were discussing an ongoing investigation. Brown's spokesman, Scott Gerber, declined to comment.
The subpoenas for documents were issued to Gold Bridge Capital and Wetherly Capital -- both run by former fundraisers for former Gov. Gray Davis -- as well as former pension official Sean Harrigan, according to sources. It was unclear which of the subpoenas had been served as of late Friday.
Brown pulled back on delivering a subpoena to equity investor and fund manager Elliott Broidy, after he volunteered to talk with the attorney general's investigators, a person familiar with the investigation said. Broidy and Harrigan, both appointees of Los Angeles Mayor Antonio Villaraigosa, recently resigned their posts on the Los Angeles Fire and Police Pensions board after they were contacted in a related U.S. Securities and Exchange Commission inquiry.
The nationwide probe began in New York, where Atty. Gen. Andrew Cuomo has indicted six people in an alleged kickback scheme involving placement fees in the New York State pension fund. That investigation spread to numerous other states, including California.
Wetherly Capital, a Los Angeles-based placement firm run by Dan Weinstein, was mentioned but not charged in the New York indictment, which said Wetherly paid $313,000 in fees to companies controlled by Hank Morris, an indicted political aide to former New York Comptroller Alan Hevesi.
Two weeks ago, former Wetherly employee Julio Ramirez Jr. pleaded guilty to securities fraud and agreed to cooperate in the New York investigation.

Gold Bridge, operated out of San Francisco and Sacramento by Darius Anderson, a prominent Capitol lobbyist, and his brother Kirk Anderson, has received at least $5.2 million in placement fees for deals with New York's pension fund and has received fees for investment deals at CalPERS, California's public retirement fund, and CalSTRS, a teachers' fund, documents show. Both Wetherly and Gold Bridge were subpoenaed by Cuomo three weeks ago for documents relating to their licenses.
A spokesman for Wetherly Capital said he was unaware of any subpoena by Brown. A spokesman for Gold Bridge, Dan Newman, said, "Darius Anderson has always acted with the highest possible integrity and intends to work with the attorney general."
Jim McCarthy, a spokesman for Broidy, said his client had not been subpoenaed.
"I have no information on that," McCarthy said when asked about Broidy's offer to meet with investigators.
Harrigan's attorney could not be reached.
Harrigan and Broidy stepped down from the Fire and Police Pensions board after receiving letters from the SEC. The letters asked Harrigan and Broidy to reveal any contact they may have had with three firms under review in the pension inquiry there.
They also were asked to identify all of their income since Jan. 1, 2005, and any money they may have earned from firms seeking business from their board. Broidy and Harrigan said earlier this month that they had committed no wrongdoing but believed they had become a distraction for the pension agency.
Broidy is the co-founder of Markstone Capital Group, a private equity firm in Los Angeles. When he stepped down from the Los Angeles board two weeks ago, Broidy said he was cooperating with various investigating agencies and had "never profited in any way" from his work overseeing the $11-billion investment portfolio.
Harrigan served as president of the Fire and Police Pensions board at the same time that he was working as a private consultant to companies that had business before his and other pension agencies. As a consultant, Harrigan has represented, among others, Wetherly Capital and Yucaipa Cos., an investment firm founded by supermarket magnate Ron Burkle.
Other Harrigan clients included the Chicago-based investment fund Gardner Rich and Co. and Grant & Eisenhofer, a law firm that had been seeking to perform securities litigation work for the L.A. Fire and Police Pensions system.
Harrigan said he recused himself from voting on business involving his clients up to one year after he worked for them. Still, city lawyers were so concerned about Harrigan's conflict that they asked the pension board to rescind a vote that would have made Grant & Eisenhofer one of the agency's five securities litigation firms.

I am astonished to see that some are clinging to the wreckage of the Jack Weiss campaign by blaming local media for publishing 'hit' pieces against Jack Weiss.
A 'hit piece' is something either;
1) untrue,
2) irrelevant but nevertheless embarrassing or
3) slanted unfairly against the 'victim.'
So which of the categories do the 3 'hit pieces' fall into?
First, Maeve Reston wrote about Jack Weiss's on-going refusal to pay to the City Treasurer the illegal money-laundered campaign contributions that he received from an executive and associates of Alan Casden's development corporation. Trutanich had challenged Weiss over this at the televised debate at the Westside Jewish Center. Weiss said Trutanich was distorting facts and that the "matter was settled years ago." Why should we accept Weiss's word? Reston, as a reporter had a duty to investigate, especially as Weiss's claim of "years ago" seemed false in the light of the Fair Political Practices Committee's 2007 demand to Weiss to pay the money as required. I think Reston concluded that Weiss faced several procedural obstacles in actually paying the money. So, the article was not 1) untrue, 2) irrelevant because ethics is perhaps more important for the City Attorney's post, nor 3) slanted, because Reston reported on Weiss's difficulties in paying the City Treasurer.

Weiss Hit Piece - Cont
Next came Dave Zahniser's story on Weiss's illegal fundraiser held on April 27, 2009, in Beverly Hills. City Commissioner Kelly Candaelle co-hosted the event in direct violation of the law - LA Municipal Code 49.7.8, which prohibits city appointees from engaging in fundraising for city elections. Jack Weiss attended the fundraiser, and doubtless saw Candaelle there. It must have occurred to Jack Weiss that the fundraiser was unlawful as Weiss not only voted to pass 49.7.8, but Jack Weiss also voted to appoint Candaelle. Zahniser did not state the obvious; that Jack Weiss openly allowed the law to be broken in his presence and to his advantage, instead reporting that when he (Zahniser) contacted the Mayor's office the following day, the Mayor's response was to deliver the resignation of Candaelle within 4 hours. Zahniser's article was neither 1) untrue, 2) irrelevant, as Weiss is running for the post of chief law enforcement officer, so his tendency to misapply the law, or be ignorant of it, is highly relevant, and 3) it was not slanted as the focus was on Candaelle rather than Weiss.
The third alleged 'hit piece' occurred when FOX 11 news reported on a May 3, 2009 Hancock Park fundraiser that Weiss attended hosted by a person who had been convicted of several fraud and theft related felonies surrounding the operation of medical facilities. The story was not 1) untrue, and it was 2) relevant to the character of and choices made by Jack Weiss. Remember, Weiss had made the issue of associations with criminals a central theme in his negative ad against Trutanich for being a defense attorney. Of course 3) the slant of the report focused on Weiss, but then again, there really was no other logical focus; it was Weiss who made the decision to attend the fundraiser. Weiss compounded the poor choices he made in attending this event when he pretended that he was hearing of the gaffe for the first time from the Fox 11 reporter. In fact the Weiss campaign had known about the gaffe for 5 days prior to the Fox 11 interview, and had undertaken to return all donations.
All three 'hit pieces' fail to make the definition of a hit piece. They are, at best, fair and truthful reports of poor choices made the candidate for City Attorney, and at worst, worrisome with regard to the way Jack Weiss considers the way that laws either apply or do not apply to him.
Voters had every right to make informed choices particularly when Weiss had raised the issue of character with his bizarre denigration of the ethics of the legal profession. In the end the media saw at least three relevant, newsworthy and truthful red flags to Jack Weiss's candidacy, and to fail to report them would have been the equivalent of a 'hit piece' on the electorate.
If you really believe that Weiss was treated unfairly, tell us why.

The Prop 8 ruling is proper from an institutional standpoint. The voters passed it and the voters will have to be asked to change it and place marriage equality in the Constitution. The Supreme Court's decision is principled and correct as no one, not even in the heat of this battle for equality, is entitled to an exception from the constitutional rule of law.
The fact that the existing marriages remain valid show that the Supreme Court went as far as it could. It just could not, with an eye to history, overturn a valid constitutional amendment -- that is the role of the voters.
Hearts and minds are being changed every day. Not to worry. Marriage equality will prevail and I think sooner, the better.

You people are so sick and spiteful, you're still hacking Weiss's wikipedia sometimes a half dozen times daily, obsessively, compulsively, turning it into an attack site for him just like you did other sites. Trutanich must be very worried about him to still be sick enough to pay someone to do that.
That's another thing that if the Weiss camp did would have been featured in a story. But if they retaliate it will be posted as though they did it first, just like with the whole campaign.
The extreme bias is being exposed and there's nothing your vitriol can do about it.
And now your guy's going to be exposed for what he is, what was never disclosed by the PR Press.
Everyone in Pedro is talking about how some young punk relatives are peddling influence of Uncle Nooch and the Trutanich name already. People aren't saying he looks and acts more like a Vegas pit boss for nothing. Speculation he wouldn't disclose his client list and the paper didn't push him to although it was legal because it just might extend pretty close. Hope what was hidden isn't going to make people really sorry.

Anon 2:26PM must be the last rat on the SS Weiss-tanic.
Here's a chance for you to tell us why the three things that put the final nails in the Weiss campaign coffin are 'hit pieces' and you squander the opportunity to retain a little dignity and credibility with wild and frankly, childish personal attacks.
It didn't work for Weiss, did it? He couldn't counter the bad facts with anything but hysterical slurs and really pathetic hit pieces. Was that your great idea? I hear Jack split town to "spend more time with his family," and Averil 'Ace' Smith is long gone, so you must be the last of the campaign staff.
So go on, give it your best shot, explain how Jack was wronged by these three stories.
I'll make it easy for you - multiple choice answers (did you ever do those?)
1. The "Jack kept illegal campaign contributions" story was not a hit piece because:
(a) It was true
(b) It was bad for Jack
(c) It showed that Jack makes poor decisions
(d) All of the above.
2. The "Jack flagrantly broke the law at Kelly Candaele's fundraiser" story was not a hit piece because:
(a) It was true
(b) It was bad for Jack
(c) It showed that Jack makes poor decisions
(d) All of the above.
3. The "Jack and the convicted felon fundraiser" story was not a hit piece because:
(a) It was true
(b) It was bad for Jack
(c) It showed that Jack makes poor decisions
(d) All of the above.
As for "And stop blogging on our dime, you're supposed to be working for your boss Cooley." Sorry but you're wrong again (at least you're consistent), I'm on my own dime. Took a few days off to spend some time with my family. Wonder if I'll run into Jack...
Now, how about answering the questions? I'll give you a clue, (d) is a safe answer.

Weiss adherents on this blog appear to have a problem incorporating verifiable facts in their arguments. Perhaps that is why these adherents so often resort to ad hominem attacks that would only convince imbeciles.
And perhaps that is why these Weiss adherents almost always, if not always, POST ANONYMOUSLY.
For example, a Weiss adherent (Anonymous 5:54) asserts: “That you should BOAST about spending your time putting lies and attacks into someone's sites . . . .”
Anonymous 5:54. Who boasted about “putting lies” anywhere?
Furthermore, would you be so good as to provide an example of such a lie?
Actually, what has often occurred on the Wikipedia Jack Weiss site is that content meeting Wikipedia’s verifiability standards–but unflattering to Jack Weiss–has been deleted for no valid reason, pursuant to Wikipedia’s standards.
Regarding Weiss adherents whining about “hit pieces” against their “feet, legs, and torso of clay” paladin; David Berger has ably addressed the hollowness of these assertions. Furthermore, alleging that the Los Angeles Times was conducting a “hit” campaign against Weiss appears ridiculous, considering that the Los Angeles Times:
(1) Devoted no or little coverage concerning Weiss using convicted felon Michael Rosenberg for fundraising;
(2) Devoted no or little coverage concerning Weiss campaign manager Ace Smith being accompanied by prominent defense attorney Stephen Madison to a press conference calling for an investigation into the illegal Candaele/Weiss fundraiser;
(3) Devoted no or little coverage to whether the Weiss campaign returned monies collected as a result of the Rosenberg and illegal Candaele fundraisers, consistent with statements reportedly made by the Weiss campaign.
So far, the Weiss adherent(s) on this blog have yet to address Rumpole’s 4:13 p.m. multiple choice quiz. Would a True/False quiz be more palatable to said adherent(s)?

RON BURKLE/YUCAIPA – FROM GROCERY STOCKBOY TO PENSION FUND “BAG MAN”! HE DOES NOT BELIEVE IN TEN ITEMS OR LESS.
The United States is in the middle of the biggest financial investigation in history. The investigation, launched by New York Attorney General Andrew Cuomo, is now coast to coast. The SEC is involved in at least New York and California. To date five people/companies have been indicted for felonies and securities fraud and three people/companies have cut deals ranging from felonies to a civil resolution (The Carlyle Group). Hundreds of subpoenas have been issued. Dozens of people are targets. Lives and businesses have been for ever destroyed. Many names and companies have been mentioned in indictments and the press.
One name is conspicuously absent. The one man more powerful in Los Angeles (when it comes to political fundraising and access/pay-to-play) than the Godfather, Dick Ziman, himself - Ron “grocery BAG man” Burkle.
What am I talking about? Just look at the list of who’s who of Burkle’s private equity company Yucaipa. Working for Yucapia, at one time or another, has been:
1) Former President Bill Clinton- The former President has toured the world on behalf of Yucaipa raising money from everyone, including all the major public and private pension funds and Unions. Clinton has his own room at Burkle’s mansion, Green Acres. Rumor has it that the two often live the life of degenerate playboys. As a matter of fact, Yucaipa controls the distribution arm of Playboy and Penthouse (Source Interlink).
2) Ari Swiller - Mayor Villaraigrosa’s power broker. The person that ran the Mayor’s transition team and is pulling the levers behind the curtain. Swiller was a principal at Yucaipa with responsibilities which included raising Yucaipa’s private equity funds, strategic investment planning, public relations, and community affairs.
3) Adrian Gaines – a placement agent for Yucaipa who recently worked for indicted Saul Meyer and Aldus Equity.
4) Horatio Sparks – Deputy Comptroller for Pensions under Billy Thompson, New York City Comptroller.
5) Darius Anderson – Of Goldbridge Capital. A placement agent that is in the middle of the national investigation.
6) Dan Weinstein of Wetherly – If this is a shock; you have not been awake for the last few weeks. Wetherly has been involved in every part of the corruption investigation. Weinstein did placement work for Yucaipa along with Vicki Schiff, Peter Borges, and Dick Ziman. William H. Jackson, longtime Wetherly Captial attorney was appointed CRA Chairman by Villaraigosa in '95 when he was first took office.
Burkle’s team, grows and grows, and uses its power, influence, and access to pay-to-play better than anyone else. Yucaipa has raised money from all the major pensions funds including $1 billion from CalPERS and big money from New Mexico, New York State, and New York City pension funds to name just a few.
Why is Yucaipa and Burkle not being investigated? Is this, again, selective prosecution by Attorney General Andrew Cuomo? Is this like the pass that Cuomo has given to Marvin Rosen (the placement agent that sold the Lincoln Bedroom for Clinton)?
Oh no...I'm getting kicked out of this internet cafe...MORE TO COME!

Where is the fundraiser? Its interseting because Wendy is an Antonio person and now Cuomo is suppose to be investigating Antonio's appointees on the pension scandal so what the hell is going on?

wow. wow wow wow.
Antonio's and Jack's spinholes are absolutely freaking out.
So why exactly is it you care about what is being discussed here, on our little fringe blog?
Totally freaky.

Don't believe it I don't care, but I'm not in any way connected to the Weiss campaign. However I would never answer slimy charges like the endless repetitions of what has been discussed and dealt with in reputable places. The Rumpole Bergers and if he's Fuentes since they are always joined at the hip are the pathetic bullies who stand and just yell insults and demand you to sink to THEIR level, louder and louder.
That's how their Nooch tried to deflect from who he is and who he represents with the help of the Slimes, but it's coming out anyway. We have a right to know.
We citizens are going to find out what they've been fooled with and will be as incredulous as those who know him from pedro and SC.
His feet will be held to the fire. Some loud phony playing on the "my poor origins" crap when in fact he is ___ Those who are so mad about it are afraid of what's coming out instead of acting honorably. Oh please that word honorably is not in their vocab. The slime they keep sticking in someone's site and boast about it reflects only on their own desperation and no depths to how low they'll go and have gone. NOT going to die away for a city attorney.
When you have someone who refused to divulge his client list even though it's not only legal to do so but was his obligation (getting a pass from the Slimes who let him just say he was smarter than all the experts) you have to wonder.
With what pedro people who know the clan are saying about "punk relatives" peddling influence already, just ordered to be less obvious after it got out. With a brother Dominic Trutanich Attorney at Law who has a 1-star rating in Yahoo Business with this comment from client carter calhoun: "Mr. Trutanich has established a reputation of client dissatisfaction and borderline thievery. He is under review by the ABA to have his license revoked. Be careful! Stay away!"
This was from 07 so he can't try to spin it away as some something to do with the campaign. Anyway those sorts of dirty tricks were a hallmark of Trutanich sending his supporters to attack Weiss in chambers to get it written up by the Slimes as though it were spontaneous.
People are wondering if relatives are some of the clients the Nooch wouldn't divulge. What happened with Dominic's ABA investigation, does he even still have a license? Was he sued and had to be defended by Nooch? The Slimes should have answered all these questions BEFORE the election.
