Wednesday Open Thread: Deal Or No Deal?
Dog food guy was at City Council Tuesday, trying again to play the race card for $2.7 million. Visualize a cardboard sign, "Will cry for millions." His attempt at a tear-jerker was pretty pathetic. Call a "wambulance." Pardon me for saying so, but if the worst thing that ever happened to you is that you ate some dog food and people made fun of you, give thanks to the God of your choice, for your life has been easier than the life just about everyone whose name doesn't begin with "Queen," "King" or "Prince." Cry me a freakin' river, dog food guy!
The City Council did approve a settlement with a guy who, after trying to evade the police, received a shiatsu massage -- with flashlights. That deep-tissue experience grossed him $450,000 -- probably $300K after legal fees.
So maybe the City Council should make dog-food guy a counter-offer: you accept $450,000, and three talk-radio hosts get to pummel you with flashlights for three minutes.
In other news, Snoop Dogg was impounded again last night, right after leaving the Leno show; drugs, firearms, and a hidden compartment in his car.

By the way, you twenty-somethings didn't really think "Deal or No Deal" was a new idea, did you? There's nothing new under the sun, or the moon, either.

Hate to rain on your parade here. Get a chance to look at the Steve Lopez piece in the Times today? Seems what you and just about everybody else on this site and at KFI want to overlook is the fact that the case was never just about racism. Did you get that, Walter? Want to take a moment to digest that one?
The case was - and has always - been about 3 things:
1)proving the act was racist
2)that the LAFD retaliated when Pierce sought justice
3)that the LAFD intentionally inflicted emotional distress
All Pierce's lawyer has to prove is 2 of the points to win REALLYREALLY big at trial, and since eveybdy pretty much agrees on the last 2 points (certainly everyone at the CC meeting yesterday, including Zine and Rosendahl) and the first one is certaily debatable, well... you see where this is headed.
Maybe, in the future, you should skip the jazzy sound-bytes and headlines and just shoot for the facts.

wht the prev. poster said was it was never JUST about racism. the other 2 points reasonable people agree on. the LAFD admitted it tried to cover things up, and they clearly let the retaliation occur. employers are responsible for what happens on their watch.

They gave a FELONY SUSPECT who PLEADED GUILTY $450,000. He originally sued for $25 million. DA's comments: "Miller pleaded guilty to both charges against him and admitted two prior felony convictions in 2000 and 2002. Miller also admitted there was a factual basis for his guilty plea.
I hope John & Ken go after this one. All these settlements are costing and wasting $$$$. Love Steve Lopez slamming Rocky and reporting the bullshit on his billboard controversey.

The (LA) Times obtained portions of a July deposition late Tuesday, in which Pierce denied under oath having joined in the shaving of a fellow firefighter's groin:
"Were you ever present when a firefighter was shaved?" an assistant city attorney asked.
"No," said Pierce.
"You've never done that?"
"I've never done it."
"And if anybody said you did, they would be lying?" the attorney continued.
"They are lying," Pierce said.
Yet Pierce appears in a photo of just such an incident, and he admitted Tuesday that he had participated in hazing out of a sense of camaraderie.
"Yes, we do have what you call hazing, we do have what you call pranks, but there's a certain level you have to go to, and a certain level that has to be stopped," Pierce said.
"I was involved in those pictures, I don't deny it, but so were many others," he said. "But those pictures were done in love to guys who were promoted, to guys who had a long stint with the Fire Department."

It's not a matter of thick or thin skin. It's a matter of relevant experience. I have tried cases for 20 years. I have handled employment discrimination cases, for employees and employers. In my opinion, based on my experience, there is no way in hell this case is worth $2.7 million.
Now, you and Steve Lopez can have whatever opinions you like. But tell us what experience or research or tarot card reading leads you to believe $2.7 million is even in the same solar system, much less ball park, for this idiotic case.

The Clowncil's comments are almost certainly inadmissible because they are: irrelevant to whether discrimination occurred; made in the context of settlement negotiations; unduly prejudicial in view of whatever probative value they have.
This is a nuisance claim with a value way short of six figures. Shame on the whining "Big Dog" (as he calls himself) and his contingency partners for predictably playing the race card and trying to feed at the public trough. Let this go to trial.
Well, as was noted at one press conference, it was determined that Pierce - had he be able to continue on the force - would have made close to 1.6 million, all told. FFs, with overtime, can make 100,000 a yaer. Now multiply that by at least 10 (he's 51, I believe, and in great physical health). After that, FFs go inot the drop program for another 5 years, then there's the pension, which can be up to 100%... is your calculator smloking yet?
Now add in emotional trauma - sorry, gang, gotta include that - which the LAFD basically copped to... what was the original question, Walter?
So no one's interested in the allegation that the LAFD retaliated against Pierce for standing up to the department? Or that it engaged in a cover up? Or that "City Controller Laura Chick said earlier this year that in an audit of the department, 87% of black firefighters said they had witnessed or experienced discrimination."
It seems to me that people have gotten caught up in the headlines and not taken the time to familiarize themselves with the facts of the case (or even read an entire aricle about it). Not that that's anything new.
What I want to know is why is it that when it happens to a black its racism but if it happened to a Latino and Asian as Pierce is shown with photos doing its ok and done out of love? I'm tired of the blacks using the race card. Can Perry, Parks, Wesson and LaBonge be that igornant? Yup. With all the murders in South LA with black on black crime you would think these people would bring the limelight to that situation. But then again they want to distract and are in denial about their very own people killing eachother.

I see no one has brought up the details in the settlement offer... this whining puppy was offered $2.7 million as a settlement, and other considerations:
1) Ten additional years in senority.
2) Retirement benefits equal in rank to that of a Battalion Chief.
The taxpayers would be getting rooked on this settlement!

Not everyone has a stellar batting average. And of course that includes me. (Sigh) But then again, my posts are nowhere near as long as Mr. Dogg's posts, and certainly make about as much sense.
However the one thing Mr. Dogg and I have in common is the ability to hit a nerve now and then. As for hitting me in the face with a glove, one cannot hit what one cannot see, savvy? I'm just thankful it wasn't a two by four across the buttocks.

Just wait until the facts in the LAFD firefighter Brenda Lee case comes up (same attorney, G. Harrison), and some white firefighters have lawsuits in the works too on various complaints. The Captain Frankie Lima case is gonna be the REALLY interesting one and will reveal much about the management of the dept. by chief Bamattre....
