Pacheco faces DUI charges
City Atty. Rocky Delgadillo filed misdemeanor drunk-driving charges Thursday against ex-City Councilman Nick Pacheco, a former city prosecutor and onetime candidate for district attorney.
Pacheco, 43, was pulled over by police at 2:30 a.m. Jan. 1 while driving through the eastern edge of downtown Los Angeles. He had been driving erratically on Santa Fe Avenue just north of 6th Street, according to Delgadillo spokesman Nick Velasquez.
A resident of Eagle Rock, Pacheco served on the council from 1999 to 2003. He lost his reelection bid to Antonio Villaraigosa, who became mayor two years later.
Arraignment is scheduled for Jan. 24. If convicted, Pacheco could face a $1,000 fine and as much as six months in jail.

Orange County Sheriff Michael S. Carona said this morning that he was resigning effective today to concentrate on fighting federal corruption charges that he sold access to his office for thousands of dollars in gifts and kickbacks.
Carona's longtime political advisor and attorney, Michael Schroeder, said at a news conference this morning that Carona's resignation was in no way an indication that the three-term sheriff intended to plead guilty and that "no new evidence had popped up" to cause him to step down.

Schroeder said that in addition to Carona being able to devote himself full time to his defense, his resignation would put to rest the question about whether he could accept free legal help from a prominent law firm. The state attorney general's office said last month that it was looking into a complaint that legal aid donated to Carona could violate a ban on expensive gifts to elected officials.
Schroeder said Carona was "looking at hundreds of thousands in legal fees, fees that will exceed his net worth." He said the resignation was "absolutely not" part of a plea bargain and that the defense expects the trial to get underway in June as scheduled.
In one of Carona's final actions last week as sheriff, he fired Assistant Sheriff Dan Martini. Schroeder would not say why Martini was fired, only that the sheriff did not need a reason because Martini was an at-will employee.
"It was part of the reorganization that needed to occur," Schroeder said.
Carona will immediately begin receiving a pension that amounts to his final salary of nearly $200,000 a year, Schroeder said. Carona's departure is not a financial decision, he added, because the sheriff could have resigned at any point and received the money.
Carona's defense will be led at no cost by attorney Brian A. Sun, who won a settlement with the federal government in the case of former Los Alamos nuclear scientist Wen Ho Lee, who was accused of being a Chinese spy. Sun is with the Jones Day law firm.
Carona will repay Sun for the work he has done on the case until today, Schroeder said, and will repay his personal attorney, H. Dean Steward, "as he can."
In a statement posted on the Sheriff Department's website, Carona, 52, said that "it has become clear to me that the interests of the Orange County Sheriff's Department and the residents of Orange County would be best served if I am not distracted from my duties while defending the charges recently brought against me by the federal government."
"Although this is one of the most difficult decisions I have ever made, my family, my staff and my lawyers all believe that this is the right time to take my retirement," he wrote. "This action will permit me to focus on vindicating my name and refuting the false charges which have been made against me and my wife."
Prosecutors allege that Carona tried to enrich himself, his wife and his mistress by trading favors for cash and gifts.
His resignation comes a week after he had returned to work following a self-imposed leave of absence. In early November, he announced he was taking 60 days of paid leave. Soon after, he, his wife Deborah, and Debra Hoffman, a woman authorities describe as his longtime mistress, were indicted in a federal corruption case.
Carona faces conspiracy, mail fraud and witness-tampering charges; his wife is charged with one count of conspiracy; and Hoffman with one count of conspiracy, four counts of mail fraud and three counts of bankruptcy fraud.
Before resigning today, Carona promoted Assistant Sheriff Jack Anderson to second in command, leaving Anderson to fill in for him until the Board of Supervisors appoints a successor to complete Carona's term, which ends in 2011.
Carona said he first asked Undersheriff Jo Ann Galisky to step in, but she declined, citing personal commitments. In what he called "an effort to restructure management and ensure continuity," he returned Galisky to the rank of assistant sheriff.
Attorney Steward said Carona chose to announce his retirement on the website because he didn't want to be distracted while preparing for his trial in June.
"Politicians calling for his resignation played absolutely no role in this," Steward said. "The most important thing was we need Mike on a daily basis and we got used to having him in the 60-day period he took off. We need his continued help in the defense. It's very, very time-consuming."

Why in the world Mayor SAm would you give an open thread to a guy who can't even find a job, pay his own way in life and is a total loser? SACRAMENTO -- Softening his past opposition to changes to California's term-limits law, Gov. Arnold Schwarzenegger has decided to endorse a February ballot measure that would allow many sitting lawmakers to run for office again this year rather than be forced to leave the Legislature, said people close to the governor and the campaign.
Schwarzenegger's backing is a boost for the Proposition 93 campaign and its chief proponent, Assembly Speaker Fabian Nunez (D-Los Angeles), who will be forced out of his seat after this year unless the term-limits law is changed.
Nunez endeared himself to Schwarzenegger by pushing the governor's health care overhaul through the Assembly last month. And the speaker has offered only muted criticism of the governor's plan to cut education, health care and social services spending to balance the state's budget.
Schwarzenegger denied last month that the two had cooked up "an exchange" of support for their pet measures. But his endorsement conflicts both with his original view on term limits -- that he opposed any changes -- as well as comments he made throughout last year that he would support changes only if a measure were placed on the ballot to strip lawmakers of the power to draw their own districts.
The governor was planning to make his position public on Tuesday, said the sources, who said they spoke on condition of anonymity because the governor's office wanted to control the timing of the announcement.
Proposition 93 would reduce the total number of years a legislator can serve from 14 to 12. But it would allow lawmakers to serve all of their time in either the Assembly or the state Senate, unlike the existing law, which limits them to six years in the lower house and eight in the upper house.
In addition to possibly extending Nunez' time in office, the measure could lengthen the terms of Senate President Don Perata (D-Oakland) and more than a dozen other sitting lawmakers. That provision has led opponents to describe the initiative as a thinly veiled effort by incumbent politicians to maintain their power.
The California Republican Party opposes the measure, and the only other statewide elected Republican, Insurance Commissioner Steve Poizner, is among those bankrolling the campaign against the measure.
Tony Quinn, a retired Republican consultant, said the governor's support for the proposition was "a sign of weakness," because the Democratic leaders did not meet his demand to place a redistricting measure on the ballot.
"If this is a quid pro quo for health care, which every single Republican in the Legislature opposed, this is going to only make them more alienated and make it more difficult to get a long-term budget solution," Quinn said, alluding to the veto power that Republicans hold over the annual state budget. "For him to further appear to be so willing to pander to the Sacramento establishment, it certainly undercuts the image he ran on five years ago."
The Yes on 93 campaign, which is being run by Nunez's campaign consultant, Gale Kaufman, did not respond to requests for comment. The campaign's spokesman, Richard Stapler, denied knowledge of Schwarzenegger's endorsement. The governor's office also declined comment.
Schwarzenegger was elected in 2003 on a campaign platform that included unqualified support for the state's 1990 term-limits law. A month before the October 2003 recall election, Schwarzenegger issued a statement describing himself as "such a strong believer in term limits" and declaring that "a change in the current term limits law would further entrench the special interests."
"As we are now seeing with the state's budget crisis and anti-business policies, it is too easy for the politicians to become disconnected from the people they are supposed to represent," Schwarzenegger said in that statement.

New national polls showed Senator John McCain leading the Republican field after his comeback in last week's New Hampshire primary, with Mitt Romney fighting to save his campaign in Michigan, where his father was once governor.
Among Democrats, Senator Clinton was on top nationally, leading Senator Obama 42 to 27 percent, according to a CBS News/New York Times poll. Another survey by ABC News and The Washington Post suggested this lead was much smaller -- 42 percent to 37.
I am so disappointed in Arnold. As a self made man, he understands what it takes to run a business and a State. I never expected that he would give everything away like the So. California Democrats. Who will be left to pay the bills?

The graciousness of fellow activists is inspiring. I like S-T, but I know of a lot of little neighborhoods that are so full of character and different. None that I would want to live at, but all that I'd like to visit often.
