The volley continues - Westchester NC joins opposition
The Westchester/Playa Del Rey Neighborhood Council turned up the heat last night and not only opposed Measure R (Term Limit Extensions) but H (Housing Bond) as well.
I have to wonder out loud that maybe if the City Council would have -- FOLLOWED THE CHARTER -- and provided time for Neighborhood Councils to provide input this wouldn't be happening.
Note to City Council: This action was both foreseeable, and preventable.
Below is the text of both motions passed unanimously:
To: Mayor Antonio Villaraigosa, Los Angeles City Council, and Los Angeles Congress of Neighborhood Councils

Resolved, that the Neighborhood Council of Westchester/Playa del Rey opposes Los Angeles City Measure H, the $1 Billion Affordable Housing Bond, on the November 7, 2006 general election ballot and encourages all registered voters in the City of Los Angeles to vote against Measure H. NCWPDR opposes the bond due to the lack of input by neighborhood councils as required by the Early Notification provision in the City Charter, the cost and the market timing of the proposed bonds.

WHEREAS Ballot Measure R is entitled "Councilmember Term Limits Of Three Terms; City Lobbying, Campaign Finance And Ethics Laws. Charter Amendment And Ordinance Measure"; and
WHEREAS the Measure mixes two separate issues on a single ballot and obscures the largest reform, which is to give City Councilmembers the possibility of four more years in office; and
WHEREAS the City Attorney has advised that, as such, the Measure may not conform to State law and therefore makes the City vulnerable to costly litigation; and
WHEREAS the City Attorney has also suggested that the Measure may in fact weaken current City Ethics standards; and
WHEREAS the Measure was drafted by a law firm which represents the interests of lobbyists; and
WHEREAS the City Ethics Commission, an independent watchdog panel created by voters, was denied the opportunity to approve or reject the recommendations, nor even to review the proposal and/or to make recommendations for revisions before it was adopted; and
WHEREAS the Measure revises current standards and will allow lobbyists to remain hidden from public view until after winning favors for a client; and
WHEREAS the Measure was rushed through City Council hours after its arrival; and
WHEREAS there was no Early Notification to Neighborhood Councils, as required by the City Charter; and
WHEREAS our stakeholders were refused an opportunity for informed participation in drafting the Measure; and
WHEREAS the Neighborhood Council of Westchester/Playa del Rey insists that Los Angeles city government remain open and transparent and include opportunities for public participation in all decision-making processes; and
THEREFORE BE IT RESOLVED that the Neighborhood Council of Westchester/Playa del Rey opposes Ballot Measure R and urges its stakeholders to vote "No" on November 7; and
BE IT FURTHER RESOLVED that the Neighborhood Council of Westchester/Playa del Rey opposes extending term limits from two (2) to three (3) four-year terms for all Municipal offices.

When you become an elected official, you can say that you are "a politician from California", or "IN politics". Walter is a has been candidate who never was, and never will be.
Just because some members of NC's vote for a particular issue or measure does not mean that they represent the people of their neighborhood. For every 1 active member of an NC, there are 10 non-active members. Hell, i know about my NC back in L.A., but i get more accomplished by not being part of them and going directly to my CM for things that i want changed in my neighborhood. And it works out fine.
Many of you just like to hear yourselves talk and believe your own bullshit. What may be best for YOU, may not be best for the citizens of Los Angeles.
Do you realize that neither one of you all will ever be elected to a citywide office? However, if for some reason you do, I will donate $500 to your campaign (as i'm sure you'll set up a PAC), give it to you myself at an event, and introduce myself to you as the guy who doubted you that lives on both the East and West coast. Maybe i'll bring one of my clients with me for you to take a photo with so that you can post it on your website to show that you have his/her support.
Let's see what comes down in November. Stop trying to be more than what you really are. Even Melrose Larry knew what to call himself a "political whack". Be a NIMBY but stand for more than only what is right for YOU.

When Alger stood up to DWP he didn't do it for him, he is a renter who doesn't pay water. The THOUSANDS who voted for the sitting CMs in every community in every district in the city have now been TRUMPED by the mere HUNDREDS in those same communities (except West-by-Northridge and West-by-Midcity... there it's just DOZENS), and the City Councilmembers' 10-20 times as many votes and supporters are voided, because Junior on the local NC got elected as a a local "advisor" to the city's supreme legislative body.

I am not sure about the whole "war" analogy but there is a battle going on here between SOME City Council members/staffers (and City Departments)and SOME Neighborhood Councilmembers.
It didn't begin with the council file issue, but that was the final straw.
I must draw a parallel to the DWP rate hike fight that I led a few years ago. We opposed the rate hike, the DWP opposed us. In the end, not only did we get the rate hike kicked to exactly where we were willing to negotiate it to in the first place, we got a long term Memorandum of Understanding with the DWP. In other words, they "lost" more by fighting than if they would have just conceded. (although I would argue the MOU wasn't really a "loss")
Now in the end the council file issue will pass. We will get that but in the process some City Councilmembers have slapped the NC's so hard as to demand a response. So at the end of the day the NC's will in all likelihood get their council file issue, and defeat 2 different propositions making the "loss" greater for the City Council (not to mention humiliating).
Now what do these issues have amazingly in common?
When I fought the DWP rate hike I fought it 100% on the grounds that the NC's weren't consulted. That the NC's weren't given time to provide input.
That is the exact logic that the NC's are using now. Even if the measure is one we might agree with, the process was violated so it can not stand.
The irony is that these same City Councilmembers were screaming at the DWP about the process when it was the rate hike.
Go figure.

The Judge is considering the case and will rule by Friday. He agreed that the measure includes unrelated subjects. It is less clear whether this is prohibited by state law on local measures.
It is also not clear if the single subject rule even applies to referenda (i.e. a measure placed on the ballot by a legislature) versus intitiatives (a measure placed by citizen petition). Wouldn't it be like politicians to create a rule that is harder on average citizens than on themselves?
Legally, measure R is a referendum. Even though it was suggested by the Chamber of Commerce, they couldn't get enough signatures in time for the November election, so the Council did it for them. That little technicality might be the thing that saves them.

INFOMERCIAL: It's Playa Vista, a national model for urban living that's being studied around the world.
PAUL MOYER: It's an infomercial for Playa Vista, one of the most ambitious real-estate projects in the United States, home to 4,000 residents and counting, on choice coastal property near Marina del Rey.
STEVE SOBOROFF, PLAYA PRESIDENT: Traffic is better. The environment is better. We're making a positive difference in a lot of ways.
MOYER: Playa President Steve Soboroff makes a pitch that's all positive never mentioning the underside of this idyllic community, the presence of huge methane gas concentrations beneath the site.
UNIDENTIFIED GOVERNMENT SCIENTIST: There is a lot of concern with methane concentrations. If someone took an honest look at that, it could very much derail the project.
MOYER: This individual is a government scientist who's worked on safety issues at Playa, speaking anonymously to protect his job. He says not enough is known about the contamination problems at the site because, in his view, the city's chief watchdog agency, the LA Department of Building and Safety, has become a lapdog for the developer.
UNIDENTIFIED CRITIC: LA Building and Safety has been complicit with getting this project accomplished. They really don't want to know what the problems are at the site or how much threat there is to the human population out there.
MOYER: In approving Playa Vista in 2001, the City Council ordered gas safety systems installed, including protective membranes under the buildings and gas detectors inside. It also directed the Building and Safety Department to monitor these devices and keep other agencies informed. Critics say that where things fell apart.
FLORENCE GHARABIAN, CALIFORNIA DEPT OF TOXIC SUBSTANCES CONTROL: There is no monitoring data...None certainly provided to our department.
MOYER: Florence Gharibian of the California Department of Toxic Substances Control has complained repeatedly to city officials about the lack of inspection data on Playa's safety systems. Without it, she says there's no way to know if they're working properly and if the site is safe
GHARIBIAN: We're not really working with all the information we need to make those kinds of judgments.
MOYER: To assure oversight, the City Council ordered Building and Safety, together with the fire Department, to prepare annual reports on methane hotspots throughout the city, including Playa, and to create a Task Force, open to the public, to keep the community informed of safety issues
COUNCILMAN BILL ROSENDAHL: All that information should be disclosed. Remember we have 4000 people living there and their safety is my number one concern.
MOYER: Councilman Bill Rosendahl, whose district includes Playa Vista, recently asked Building and Safety for copies of the annual reports, which he expected to date back several years. All he got back, he says, was a single document, prepared recently, that contained few specifics and no mention of Playa Vista.
ROSENDAHL: It's confusing and it's potentially manipulative and obviously. I'm not happy.
MOYER: As for the public Task Force, he says Building and Fire officials tried to convince him that it exists when it doesn't. In this letter to them he accused them of "either an egregious mistake or a flagrant disregard for a Directive from the City Council."
ROSENDAHL: I'm insulted. The direction from the city council was clear of how this process was to go forward. It was stamped by the city council of Los Angeles. They seem to have ignored it.
MOYER: Also ignored, say critics, are city ordinances requiring an orderly approach to the issuing of Building and Safety permits at Playa Vista, including permits to insure the methane controls are in place.

When the letter came out he'd written to the mega-millionaires (saying "take her, she's "your" candidate... for the RIGHT price of course), it was a huge embarrassment to her, and her campaign people (Parke Skelton, et al... sound familiar?)
Parra was obviously feeling a bit left-out at the time, since he'd just been "kicked to the curb" as someone else succinctly put it here, when ADV carpet-bagged in to CD14 to run for CM in '03. Parra was told to "heal," not split the anti-incumbent faction, and wait for another turn like a good lapdog. (Looks like he's getting in line and looking for a bit more visibility

The more folks you inform the stronger the opposition for this measure will be. Having the judge change the name of the measure is just the first step. It's time to stop talking boys and girls and get moving. Get folks involved and get them to vote in November. That is the only way things will change, with strong numbers in November.

Well I did go to and graduate from a high school in LAUSD and went on to graduate from a university. As a matter of fact my two siblings also attended the same high school and went on to attend a university and receive their degrees.
I am amazed at how many people I know attended LAUSD schools and continued their education at universities across our nation.
Maybe we accomplished our goals because we had a passion for learning and worked hard to achieve them. We worked all the way through high school and college to afford the costs. We took out loans and have paid them back.
We never blamed anyone for our lot in life, so we never considered ourselves victims. We were too busy working to achieve our goals.
Many of our parents never attended college, some of our parents never even finished high school. But we made it through.
But back then schools had rules. And all students had to follow them. Teachers were respected not only by the students but by their parents. Classes were crowded and sometimes we even shared books.
Today there are no rules. Students think school is a social event. They spend more time getting ready to go to school then on doing their homework. And they are shocked when they receive a failing grade running home to their parents blaming everyone else but themselves. And to add insult to injury their parents run down to the school blaming the school, teachers, books, learning aids and anyone or thing they can except themselves or their own children.
Just like they blame the police for gangs, not their neighbors who gave birth to them. They blame their city council member for the graffiti around their neighborhood instead of the criminal who did it.
We need to take personal responsibility for our actions or lack of. When people start taking responsibility for themselves and their children our schools will change.
The mayor can't even fix the problems of our city and to mask that by trying to take over the school district is painful to watch.

Los Angeles voters will know by Friday afternoon whether a measure that would give City Council members an extra term and add new ethics rules will be on the Nov. 7 ballot.
Los Angeles Superior Court Judge Robert O'Brien considered a petition this morning to strike Proposition R from the ballot, but did not issue an immediate ruling.
Opponents who filed the petition say the measure violates the state constitution's requirement that measures address only a single subject.
Opponents charge Prop. R combines changing the City Charter to allow City Council members to run for a third four-year term with changing a number of lobbying and campaign finance disclosure requirements.
But the City Attorney's Office - as well as the League of Women Voters and Los Angeles Area Chamber of Commerce, which proposed Prop. R - argued in court today that the single-subject requirement has never been applied to a City Council-sponsored initiative.
Attorneys for the city and Prop. R proponents also argued that the two issues - term limits and ethics reform - are part of a package designed to lessen the influence of lobbyists and special interests on City Hall.
"As long as they serve a common goal, the single-subject rule is satisfied," said Valerie Flores, a managing assistant city attorney.
But opponents including neighborhood council activists, have argued that the two issues are not part of comprehensive reform.
Rather, they say, the ethics reforms were added in an effort to entice - or fool - voters into adopting the term-limit extension.
O'Brien today said that the stated goal of limiting the influence of lobbyists is not necessarily apparent looking at Proposition R.
He also noted that across the country, term limits have been controversial but ethics reforms have been popular with voters.
"It's not a stretch to suppose that combining those makes it a more palatable issue to put before the public, doesn't it?" he asked attorneys for the proponents.
Though it's common for legislators in Sacramento and Washington, D.C., to add popular items to controversial bills to help them pass, O'Brien observed: "It's different when we go to the public."
The judge added the main question he will be considering is whether the state's single-subject rule applies to Proposition R.
He must rule by the end of Friday, which is the Los Angeles County Registrar/Recorder/County Clerk's deadline to begin printing ballot information for the November election.
The lawsuit challenging Proposition R was filed by West Los Angeles resident Neal Donner with the support of U.S. Term Limits, a national group that supports term limits.
City Attorney Rocky Delgadillo's office hired the firm Mayer, Brown Rowe & Maw to assist with the case - although officials could not say how much they've budgeted for outside counsel until the City Council first reviews that information.

Besided that judge, who I hope is listening, City Council dropped off this complicated Ballot Initiative at around 9:58AM, for the 10:00AM vote. And Rocky also mentioned that, "On something this important, you would want NC to weigh in, and I know some Councilmembers would like to see that."
Plus, all that other sh*t listed in the letter posted on this thread.
AND FOR ANYONE JUST TUNING INTO POLITICS FOR THE FIRST TIME:
You would have to ask yourself:
"How could council be so dumb as to try this flimsy, unethical measure when their own City Attorney's finding was that it could open you up for court challenges?"

Don't get in a tizzy about the number of voters participating in the last Westchester NC election. The election was held at about the time the mayoral General and Primary elections were held and after the November presidential elections were held and frankly, people were burned out going to the polls. A fact that was noted by the low turnout during the Mayoral elections.
Westchester's NC has a very good stakeholder membership. Probably the best in the city at over 6600 "registered" stakeholders. Not bad.
Registered stakeholders are residents, property owners and people who work in the community that actually take the time to register and become stakeholders. Not just people who happen to show up at a meeting. So 6000+ people is a pretty substantial number of residents that the city should not ignore.

9:25PM, I'm the mother of an LAUSD student. I'm also a candidate for State Assembly here in Los Angeles. Perhaps I'm one of the fairly odd parents who make sure the lines of communication between teacher and parent are open and used on a regular basis. I refuse to abdicate the responsibility for the education of my child solely to her teacher. I will always endeavor to be of assistance to the teacher, and to make sure that learning continues at home.

I want to add something to that. Taking that kind of responsiblity starts at the top, and I am reminded of how the Mayor and the Speaker of the Assembly took upon themselves the responsibility to make sure AB1381 made it through the State legislature despite the rather loud and obvious objections of the parents of the students that would be impacted.
I had a chance to read a copy of the letter that Alan Autry (Mayor of Fresno) sent to our Mayor. Mayor Autry pointed out in his letter that he felt that there was a responsbility to address the education needs of all of the children in California...not just Los Angeles. I wonder why that didn't occur to the Mayor and the Speaker.
My point is this: It's going to take parents taking responsiblity for their children and elected officials taking responsbility for upholding their oath of office. It's also going to take voters being responsible and getting out to vote in November so that change happens at the ballot box instead of being shackled to the status quo.
You have every right to be proud of your LAUSD diploma. While mine is not an LAUSD diploma, our diplomas are tangible proof that we are responsible, reliable individuals. Those diplomas show that we got our butts out of bed each morning and went to school. While there were a million other things we could have been doing, we stayed in school. We held ourselves accountable.
If only those who thought taking over the school district would do the same.
