A NC recommendation is only accepted if it's insignificant or else already on the CM's agenda.<BR/><BR/>Why don't you do something worthwhile... you know that a NC, under circumstances, can present a "file"...<BR/><BR/>Did you know, that L.A. will not remove and has no laws to remove graffiti from the sides of commercial trucks, with all the millions of dollars spent on graffiti abatement. You can call 311 to have graffiti removed from buildings but if you state that the graffiti is on a vehicle then they'll say there is nothing that can be done.<BR/><BR/>Los Angeles needs a law which states that graffiti must be removed from vehicles. Apparently, there is a fear that legally it will be contested in court using "free speech" arguments (absolutely anything can be contested in court, of course).<BR/><BR/>Councilmember's office indicates that they are working on getting the City Attorney to draft an ordinance. This has been ongoing for about a year. The Lead LAPD Officer of our area says that there is nothing that he can do.<BR/><BR/>Similarly, there is no L.A. City law to remove graffiti from buildings, except from vacant buildings, although graffiti removal is done citywide (apparently without legal justification). L.A.M.C. Sec. 91.8904 requires removal of graffiti on vacant buildings. So, most graffiti removal in L.A. is actually done only by owner consent.... again, the exception is that owners are legally required to remove graffiti from vacant buildings.<BR/><BR/>So therefore, there is a big inconsistency here. Laws are provided for graffiti removal on vacant buildings but not on vehicles or not on occupied buildings.<BR/><BR/>---------------------<BR/>FYI, the L.A. Municipal Code regarding graffiti removal from vacant buildings.<BR/><BR/>SEC. 91.8904. SPECIAL PROVISIONS FOR VACANT PROPERTY GRAFFITI REMOVAL.<BR/><BR/>(Title and Section Amended by Ord. No. 171,175, Eff. 7/25/96.)<BR/><BR/>91.8904.1. Duties of the Owner of Vacant Property. (Amended by Ord. No. 172,782, Eff. 9/30/99.) It shall be unlawful for the owner or person in control to permit the accumulation of trash, debris, vehicle parts, rubbish, excessive vegetation or other similar nuisance conditions on a parcel or in and around any building or structure located on a parcel. The Department may order the fencing of such a parcel in the manner described below.<BR/><BR/>It shall be unlawful for the owner or person in control of a parcel of land, to allow to exist a vacant building or structure which is open to unauthorized entry on that land. The entire building or structure shall be securely maintained. The owner or person in control of a vacant building, structure, or lot which is open to unauthorized entry shall secure all openings, accessible for entry from the exterior of the building or structure, and where appropriate, the entire lot itself, with one of the following methods:<BR/><BR/>(it continues, with my emphasis...)<BR/><BR/>It shall also be unlawful for the owner or person in control to allow to exist any graffiti on a building or fence when that graffiti, as defined in Section 49.84 of this Code, is visible from a public street or alley.
